I'm really confused by all this "could/should" have rejected the car. Did you, in writing, in the correct format, in a reasonable timescale, reject the car?

Just paid them the £4114 to clear it off in full.... .

....upon payment of £4213.50 your account will be settled in full.
Not sure if I am missing something but those are different amounts and to me, it seems you still have not paid the account in full.

They said what I did is fraud and they said they was going to register a cifas fraud marker, I said to them well it's not fraud really is it, I claimed it back from my bank and I explained to them why, under the credit consumer act the car was unfit for purpose and I had a chance to reject it and I they were unhelpful.

Yes it was fraud. Your issue was with the dealership - not the finance company.

Oh dear, if they do indeed follow through with a CIFAS marker you are well and truly screwed for the next 6 years. You can also wave goodbye to driving a car as well because only 2 insurance companies will touch you with a CIFAS marker and your premiums will be astronomical.

I'm reading it as OP bought a car, thought about rejecting it but didn't follow through, subsequently wrote car off and had no GAP insurance so looked to retrospectively reject it or exploit any loophole to avoid repaying outstanding balance.

Now has been caught out and has a big black mark hanging over him for next 6yrs

That would make more sense. Thanks!
