Highview Parking

I know there is multiple threads on this company and I am struggling to see which is correct as Highview have now got it on their letters that the fines are enforceable and when I called them they said that following the Parkingeye V Beavis case, they are now enforceable?

My position is, I sold a car in January, V5 sent - wasn't received by DVLA and I was none the wiser. Now a parking ticket from Highview and despite me showing them all chat logs, pictures of the car for sale by the trader who bought it on his facebook page etc that they want more proof to consider appeal. I have written to dvla but now sure they will backdate the date of sale.

The car is insured by the now owner as showing online as insured so the person clearly driving it.

Any advice as I can see from the off this company is going to make life as difficult as possible as they just keep asking for more proof

    Ask the DVLA the date when the new owner registered the car,
    hopefully they did

    Highview as usual are talking out of their backside by quoting
    the Beavis case

    Beavis lost on a point that the charges were infair.

    As this is not your case, it will show you how stupid Highview are

    When did you get an NTK? If they are treating it as an appeal then you should get a POPLA code where you will win.

    Tell them as they don't seem to believe you that you want POLA to adjudicate. If they send a code don't appeal till you have it checked over here first.

  • Thanks Waamo, I will do this. I would imagine that DVLA will only show the sale of the car from the recent dated letter I sent them to advise?

    I have all the proof of sale on a facebook chat and then the person advertising the car showing reg on their facebook page - shall I send them this do you think?

    I can't see why not. Send it to both Highview and the DVLA. It might save you grief in the long run.

    If you sold it to a trader then it's highly possible that to avoid an
    extra owner being shown on the V5, it will not be registered until sold on

    You should really get the DVLA to investigate as they can get
    information from the new owners insurance company

    In the meantime, the PPC must be informed that you have asked the DVLA
    to investigate and until they reply the matter is on hold

    Assume you purchased another car and changed your old reg to a new reg ?
  • I did. I was thinking of getting the papertrail for this to show change of insurance and DVLA confirmation etc as some back up.

    I can also get the failure certificate from the garage on the car sold and then show that the mot was done while with the trader if they wanted to check up on records perhaps?
  • Hi, just to update, if any one can please advise on next step. I provided Highview with a chat log from facebook arranging sale, pictures of the car for sale on the traders facebook page etc and they say that as the council don't have the address as registered then they will want proof from DVLA (which I cannot provide as the car was still in my name) or the full address which I don't have. This is what they say:

    Thank you for your correspondence.

    As previously advised, in order to correctly transfer liability of this notice we will require the full name and address of the buyer, or a copy of a letter from the DVLA confirming that you were not the owner on this date.
