Hi helpful people
I emailed RCP explaining the situation that resulted in my ticket and therefore seem to have made the ULTIMATE mistake of disclosing that i was driving. I thought my situation was quite reasonable (app failure) so was appealing to their better nature (!) however having now looked into this in more detail i know this is futile! I have gone through the newbies page as recommended but couldn't find an answer there.
They have come back to say they have rejected my appeal and have said the next stage is POPLA.
What i'd like your expert opinion on is whether in this circumstance i should just cut my losses and learn from it (I.E. NEVER DISCLOSE DRIVER DETAILS) or is there anything i can do?
Thanks so much in advance

Coughing up to being the driver can hinder an appeal but is only rarely fatal to it. There are a whole load of other hoops like signage, wording on the NTK etc that often win at POPLA.0

Thanks for the response. I notice on the template for POPLA appeal that it says "I declined the company’s invitation to name the driver, which is not required of me as the keeper of the vehicle"
Technically i inadvertently admitted to being the driver.
Should i change this language?
Sorry in advance, i know that there is a lot of work gone into newbies thread but i can't seem to find what i need to know.0 -
I would leave it in. Companies often respond with their own template. They may well act as if they are using POFA and fail to get it right.
Imagine the irony of winning on an unknown driver point having actually outed yourself.
A few get it right so don't pin your hopes on it, but it doesn't hurt to make them jump through the hoops.0 -
Apart from the risk of paying £100 instead of £50, right?0

We don't recommend paying even if you lose at POPLA. What is the full name of the ppc? Many have similar initials for some reason.0

Oh really? I am SO new to this, as you can tell.
The full name is RCP Parking Limited. (Can't see anywhere what RCP stands for)0 -
They have several more hoops to jump through, signage, contract, penalty, timing, etc, planning permissions etc.. It is far from a lost cause. You never know how far you can go until you go too far.0

Do you have photos of the signage? If not, get some now! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Does this help me at all please? I'm still quite confused about how i can contest this.0
