Hi all,
I've received a Parking Charge Notice (PCN) from Civil Enforcement where my vehicle has been clocked overstaying in a car park. It's my argument that the times registered by their ANPR are incorrect. I have a tracker installed in my car, and the time at which they have my car exiting the car park, it was actually on my drive. The tracker is administered by the AA, so I can't really mess with the timings - the timings are what the timings are. I have provided CE with images from the AA tracker that show the times that the vehicle arrived and left the car park - both of the times registered by CE are wrong.
What are the chances they will accept this and drop the case? There is no mention of Keeper Liability or POFA, and the issue date was 18 days after the parking event (so they can't use Keeper Liability even if they wanted to).
I've told them that I'm not going to identify the driver and that they should either bin off the charge or issue me with a POPLa code. Sound about right? If I refuse to name the driver can they do anything else now given that they haven't mentioned Keeper Liability and the issue date was too late for them to use it?

yes you are correct in trying to get a popla code and not naming the driver
they might drop it if they see a decent popla appeal , but until then they wont drop it (or are unlikely to)
there is no profit in "dropping a case" - they just want your money, nothing else matters (and no these parking companies are not sensible , they are greedy sc@mmers)0 -

You will win at POPLA with that appeal - they know it and they will cancel now, I predict.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks both. If they do drop the case, is there anywhere I can take my concerns about the timings from those cameras? I checked today and my tracker app is accurate to the nearest 10 seconds (I had 123 running when I parked up!).
I reckon that loads of other people will be getting done by this camera and the timings are shoddy at best. Unfortunately, most won't have a tracker to check this on.0 -

You should show your evidence to Trading Standards at your local Council (not the CAB).
Very glad to hear it worked - but more PPCs should get complaints made to TS. The industry is ROTTEN.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
