Redundancy payout for old contractual hour's

Hi, I am being made redundant and have reduced my hours to part-time. Whilst I've worked these part-time hours for 2 years I've never signed a contract for my new hours so could I argue that I'm on my old contract or does the fact I've worked part-time hours for 2 years mean that's my new contract?

As I've mentioned on both of the other 2 threads you've created today, we cannot offer you legal advice here.
Seek independent legal advice if needed.
Good luck!0 -
They can prove your hours / change of contract with the time passed (2 years) and hours you've done since.
So you will not be able to con your employer out of full time pay redundancy lol.0 -
I dropped to 3 days a week in Jan and have nothing in writing, nor did I request the change in writing. At the meeting (not minuted and no witness) to finalise things I was told that the reduction in hours was a change of contract and by working them I accepted the change and nothing else was required.
You should still seek legal advice if in any doubt.

Ok thanks all. I kind of guessed that. Trust me I'm not bitter about it but boy did they screw me over. Live and learn!0

redundancy pay is based on a "weeks pay" as defined in the employment act.
The relevent date for this is the day before notice of termination(most cases) and it is the pay that week or based on the previous 12weeks if variable.
signing contracts has no relevence to what your actual contract is as that can be changed at any time through mutual agreement.
by working any change unless you actively protest about the change you have agreed it as XBigman points out.
2 years is plenty of time to have deemed to have agreed reduced hours.0
