Refund Question

Hi - I'm looking for advice regarding a recent purchase in store at Nomination, although I suspect I'm not going to get anywhere.

My teenage daughter recently bought two bracelet links from a store for her Mum's birthday. Unfortunately, being a bit financially naive, she spent ten weeks of her "income" and my wife doesn't feel it is right to accept the gift (however well-intentioned). She took the items (unopened) back to the store and was refused a refund, with the attitude that "nobody forced her to buy them".

I contacted Customer Services who said they couldn't help because purchases in store were dealt with by the stores. Having contacted the store in question on social media, they tell me that Nomination have a worldwide No Refund policy. However, the Returns section of the Nomination UK website does state that you can choose a refund, store credit or replacement. Since I pointed this out to the store, I have had no response.

Do I have any recourse to get a refund? And how can a retailer offer no refund? What happens, for example, if somebody buys a bracelet link from Nomination as a gift only to find that the intended recipient doesn't actually have a Nomination bracelet?

    To be blunt, there is no legal right to a refund, it's just good customer service.

    The store is right, it was your daughters choice to purchase and this is a life lesson to think before you buy.

    You could sell it on to try and get some cash back from it.

    Unfortunately for you (or your daughter) there is no automatic right to a refund for change of mind/unwanted items. It should always be assumed that all sales are final unless you are explicitly made aware of a more enhanced returns policy.

    It would be different if bought online as distance sales allow for you to inspect a product as you would in a physical shop so with a few items excluded there is a law to allow for such cancellations.

    Maybe Mum could offer to pay half if she thinks daughter has spent too much?

    That returns policy is referring specifically to online purchases and not those made in store

    It is a legal requirement for consumers to have a right of return for most online purchases made in the UK from UK based businesses but this doesn't apply to face to face transactions in stores.
