Product not to specification - and associated costs of it being wrong.

Options
Hope you all might be able to help.

Ultimatley this hinges around buying a product, which was specified as a certain size both online (manufacturers info) and physically on the product box.
The prodcut is not the specified size.
Now I cannot install the product without some costly modifications to my house.
Ultimately my question is whether the manufacturer has any liability for my associated costs of the modificaitons I have to make to now be able to install their product?

I'll flesh out below.

The product is 20m of Phillips Hue LED lightstrip (approx £500).
On the box and online this is specified as 12mm wide. Turns out, when measurted its actually 15mm wide.

I installed an aluminum track suitable for the 12mm LED lightstrip to be fixed into (approx £250), which is now fixed in place. I cannot return this, as its not faulty and not within a return period for unwanted products.
This is installed around the perimter of the ceiling and not easy to simply remove.

This also took about 2 days for me to install. It would probably take a proffesional electrician 1 day (so lets call that £250 in my area).
The cabling and controllers for the Phillips LED are installed, so simply removing this and swapping it for another product is not easy either.

I seem to have two options:

1. Find a new aluminum track for the Phillips LED. Will cost circa £500 (supply and fitting new aluminum track).
2. Pull down the ceiling, rip out all the Phillips cabling. Return it to them and demand a refund. Find another lighting solution. Cant see that costing much less than £500 to rip down and make good the ceiling.

Phillips appear to have subsequently updated their product spec, so clearly they're aware of the problem.

I know I should have physically checked the actual product size, matched the product spec.

Do phillips have any liability beyond the cost of their product?
Obviously don't particaulry want to end up taking this to court, etc, - would prefer have a sensible conversation with phillips, letting them know their error has cost me money.
Any advice on how to apporach this/ relevant legislation I could quote to make them take it seriously.

Many thanks

Tim

    This^^

Any claim for consequential loss is likely to lose because you didn't check your materials before you started the work.

(A quick search shows several other suppliers of 12mm light strip.)

Return the 15mm strip and purchase 12mm strip? Your not out of pocket anything?

Have you spoken to your supplier to source 12mm strip?

  • Bought from Amazon.

BorisThomas - take your point, there is some responsibility on me. But there does have to be some consequence to manufacturers giving incorrect information surely? By that logic (and slighly flipantly taking it to the extreme), if a petrol station put deisel in their petrol pumps and you damage your car by filling up, they have no reponsibility if your didn't test what was coming out of the pump?

I'm hoping Phillips will be reasonable, but any suggestions of how one might convince them to be more reasonable would be helpful.

    Thanks
  • Phillips don't make a 12mm version. Never have it was just wrongly spec'd on their details.
All the phillips wiring/ drivers/ controls is already installed and its a fairly major issue to remove it.

    Bought from Amazon.

Then Philips do not even owe you the cost of their product.

As you bought from Amazon (you do not mention an Amazon marketplace seller), it is them you need to chase.

Depending on their contract, Amazon in turn can of course look towards Philips to cover their loss.
