    Thank you Mark.

In regards to the SAR, should this request be done in writing or can I verbally ask for it? I am sure they will ring me again tomorrow demanding payment now they have my number
Tell them that you do not wish to be contacted until the matter is clearer, and if they continue calling - fill in a complaint. They have no right to harass.

SAR has to be done in writing, and it may be up to few weeks before they will respond to it. And you want to hold a copy of the delivery receipt so they can't then try to weasel out of it.

In all likelihood it is your debt that you've forgotten about, it happens all the time, but always good to get all your ducks in a row first for the rare case where it isn't so.
  • Thank you for the replies.

I really haven't had any sort of credit whatsoever, honestly.

Ive actually never even had any debits on my account to anyone.

I know it seems strange but I really haven't. Ive only ever made purchases in store, online and withdrawn cash. I have never wanted any sort of credit at all with anyone so I know 100% this is not my original debt.

Ms Chocah - Ive never heard of Studio catalogue. Ive never used any catalogues to make any purchases

Identity thieves commonly buy mail order things if they have stolen your details.

A debt that old should be statute barred. That is good grounds for a set aside.

    Hi,

It may be difficult to prove fraud here, assuming it is fraud, Waamo above hits the nail on the head, the debt would of been statute barred anyway, but getting a set aside will cost you almost as much as paying off the CCJ, its a difficult situation for you.

I think the SAR is a good idea, it may shed some light on who was paying the account previously, have you any idea who could be responsible for this, assuming its not an old account you have forgotten about ?

Goods would of been delivered to the account holders registered payment address, maybe contact the original creditor, sometimes they keep records for years longer than necessary, although you may have trouble with data protection issues.

Don't forget with the SAR, which needs to be done in writing, you will need to pay a fee of £10.
