Cancellation Query

Hi All


Can anyone offer some advice? Booked a wedding abroad in Dec 2014, was originally due to be in Dec 2016 but we moved it owing to the ill health of my mum to Dec 2017 and subsequently after my mum died in Oct 2016 we decided to get married in the UK.


I informed the wedding planner who told me that I now owe 50% of the total amount of the wedding. Nowhere in any of the communication I have from them does it refer to terms and conditions and/or a cancellation policy and nowhere in any documents sent or received can I see this referenced in any way.


I can see on their website dated 2017 that they now have some terms and conditions which would reference what she is now saying but at no point have I been at all aware of there existence and the date of 2017 would come into effect after my 2014 booking. Also the terms and conditions 2017 reference a different deposit amount than I paid etc


Where do I stand here? Will I need to pay her the 50% or not?

    You may not have seen the conditions but presumably you found the wedding planner on line in the first place and it is likely there were at least some terms and conditions even then. If you didn't check or take a copy then none of us can say for certain what the terms were but having delayed the wedding once I can see they will expect some payment.

    They have presumably worked with you since 2014, booked hotels and made other arrangements for which they are entitled to charge.

    Exactly what they can charge depends on what has been done so far and whether they had conditions back in 2014, if you can't find them, ask for a copy and see what they say. If they are not based in the UK legal action may not be that simple but I would expect at some point you will have agreed terms whether you remember or not. If that is not the case, they are entitled as you are the one cancelling to paid a reasonable fee for the work done
  • Hi, thanks for the reply. Everything has been done via email so far and I have all the documents that have been sent and received either side with no terms and conditions or similar within there. I have something in a costs document which shows me the deposit, the total and the fact that balance due 2 weeks before and I don't need to worry about it until then.

    We have not needed her to book any accomodation, no food or flowers or transport, all the usual things. The venue was provisionally booked awaiting a confirmed time.

    I've asked her to share with me the terms and conditions from 2014 in case I have missed them but as I have all other documents and nothing relating to this it would be strange (but not impossible) if that was the case.
