So it would be better to defend as keeper then, as this point is not easy to evidence.

  • I'm not sure I agree with CM because haven't you already identified yourself as driver?

You said this in an earlier post:

its the latter they were communal spaces for us but as the carpark was on the high street ANPR was a deterrent to shoppers. there was 5 spaces and about 15 employees so it was lucky to get a spot but if there was one we were fine to park there as noted in the employers statement.

The part I underlined - what do you mean by this? If you mean you were given something in writing what did it say? Also, were the spaces demarcated/identified in any way as being for the employees of the company you worked for?

Sorry I meant in the letter I have off the ex employer it says I was entitled to park there
  • So was that letter post the parking event, not something you were given at the start of your employment?

Can you ask the other question I've asked 3 times now. The spaces where the employer said employees could park on a first come first served basis - are they marked out in any way? Eg with signs saying "for employees/visitors of x co"?

Also, what were you told at the start of your employment? From your posts this is what I gather:
    - you start employment
    - you are told verbally, nothing in writing, that employees can park "in those spaces over there" [boss pointing to spaces], "but it's first come first served".
This is all fine. Particularly since employer has now confirmed it in writing. But I think it's really important to show where those spaces were and that they were marked out in some way as being for x co.

Sorry Guys been really busy with work.

there was no contract it was verbally first come first served these are the spaces. there were no signs for the business they were pointed out. nothing was in the contract of employment about parking and no contract was given they were just, pointed out.

and sorry coupon mad, i had told the judge verbally at the set aside hearing, prior to that i hadn't mentioned that i had or hadn't been driving. whether or not the judge has noted down that i had told her that i do not know.

OK so you have said who was driving in court; you can't go back on that.
