  • Can anyone help?
    After buying a house that was meant to be a 6-8 week 'no-chain' sale we are now on week 15 after access issues, dealing with land registry, dealing with the council and dealing with marital settlements! We are on the last leg and the sellers need marital home rights removing - This was applied for a week ago and the application was received at land registry last night.

    Anyone have any idea or experience of how long this takes for them to remove the right and provide updated documents? We just want to get a date set now.

    The processing office have confirmed that they will be writing to you very shortly to advise on next steps.

    I won't go into the exact detail here for privacy reasons so hold fire for that letter and if you then wish to share I shall leave that for you to decide upon.

    Hi,

    I've posted some questions under this thread:

    Brief summary: I'm buying a house which was built 6 years ago, there is a chunk of text missing from the original tp1 which means that although the rights for the benefit of the property are defined they are not granted. Before my purchase can go through a deed of rectification is being sought to grant those missing rights..

    For the land registry my questions are:

    What is the current wait times on registering a deed of rectification (to rectify a tp1 filed 6 years ago with a chunk of text missing)?

    Are there ever any circumstances with which the land registry would reject a deed of rectification, if it's signed by all the original parties and simply add grants to rights already outlined?

    Would it be normal to require the deed to be registered before continuing with a sale?

    I should point out that the error in the tp1 only appears on the original developers tp1 not the original buyers (now vendors) copy of the tp1. This was reported to the land registry as an error in the hope it could be corrected without a rectification deed, but the request was rejected hence a deed of rectification now being sought

    Impossible to give a precise timescale as everything depends on what has been submitted and whether any wider checks are then required.
    In my experience IF everything is in order and it can be registered then you are looking at a 2-3 week timescale. However I should stress that rectification is a complex matter but if they contacted us first and were steered in this direction that should assist re timescales

    In my experience a conveyancer would not proceed on a purchase until it had been registered BUT that is a Q for your conveyancer (and lender if there is one) to answer for you

    The average timescale is currently 9 working days between receipt and consideration/registration. If it is all in order I would though expect it to be completed within that average, say 4/5 working days

  • Wonderful. I know their settlement is sorted regarding the divorce and everything is signed and submitted as of yesterday, just literally need removing. So hopefully 4-5 working days?

    Thank you so much for your help. I’m desperate to know the details and if it means a further delay. If I or my solicitor phoned Land Registry would they give us the details?

    Hopefully but everything needs to be in order. IF decree absolute granted then that is the best evidence. If it's a signed release then that can lead to wider checks being needed

    They should be able to advise as to why we are writing to you Yes but they would not be able to offer any specific details as they would be in the letter being issued.

    The letter is not to advise that everything is to proceed to a completed title at this stage so I would recommend waiting for the actual letter and then deciding on next steps/possible delays with your solicitor

    I have sent your replies to my solicitor and await her response. I know she was expecting approval imminently. I don’t think my chain will survive another delay.

    Thank you for all your help even if I don’t like the outcome, at least I’ve been made aware of the situation sooner.
