    There was only 2 toilet points and I already had 8 for the daily living so it doesn't make a blind bit of difference.

    I was going for a MR for the mobility part, following a journey. Don't think I'll bother now.

    Yes I have no problems walking at all.

    I have ME which fluctuates, so I'm thinking they gave me this for days I feel weak? I dunno. Not going for the MR now, can't be bothered with the hassle.

    I highly doubt that as you said you have no problems walking at all. This and toilet points you scored makes me and others think they have you mixed up with someone else. Either way something doesn't seem right to me....

    So if you hadn't have scored those 2 points for the toilet use then you wouldn't have got the daily living award either? Standard in both and you shouldn't have been awarded those points. An award you're not entitled to and you're going to ignore it. So many people out there that can't get those much needed points... I wouldn't be able to live with myself. Good luck.

    I do think you're on a sticky wicket.... particularly since you'll presumably be reviewed in future (for reference it'll usually be (in the) 12 months before the end date of the award). I am cautious because I am not convinced (by your postings here) you are any more accurate in assessing your applicability for descriptors than the assessor (or DWP DM) in this case... you seem somewhat fact and logic avoidant or defective to me and so I retain a healthy consideration you may actually be getting an appropriate award and have been accurately assessed. Claimants are not always going to be the most reliable source of facts or information in their case and sometimes because of the very disabilities or illnesses they have... or of course because of failure to understand how the criteria is applied or even what it is. But just beware you don't end up down the path of deliberate false declarations. Seems to me you could be in that tricky area between being inaccurately assessed and providing false information... I know in my case they have some of the wrong descriptors applied.. however I challenged them extensively with facts in a MR and they chose to ignore me and returned the same decision. I'll retain evidence that I tried to correct their decision (which wouldn't have made monetary difference I should add) and at reassessments I'll re-iterate the facts of my case to imply the correct descriptors. I would certainly advise you get the PA4 assessment report if not already gotten from DWP (you describe having report but you don't seem to relay any of the explanations for descriptor choices that confuse you and I would expect such to exist and make some sense unless you did indeed get someone else's report)... for your own records and future use at least... and I would tend to suggesting you talk to CAB or the like.. you don't have to follow their advice but a professional eye over the actual evidence in your case would be far more useful than perhaps we can be here when you seem unable to communicate key facts.

    No I had 8 points anyway, the toilet points were an extra 2 giving me 10.

    and its not really my fault other people can't get the points they want.

    No I don't have this? I just got the letter saying how many point etc I was given? How do I get this?

    I only have till the 12th to do a MR and I'm away on holiday on Sunday..

    I never said it was your fault but it still doesn't make it right that you're just going to accept this award. As someone stated in a previous post "it's clearly classed as an overpayment" Yes it's the DWPs error but you clearly know about this and are chosing to completely ignore it.

    Ring DWP and ask for a copy..
