Landlord refuses to re-decorate ceiling,caused by building defects

Hi,
I wonder if any body might be able to help.

I am a housing Association tenant, and have lived in my current new build property for 3 years, altho have been a tenant for over 10.

The new flat has experienced numerous problems from Day 1. The current issue with the roof, started about 2 years ago. Staining on the ceiling appeared which was as a result of something dripping from the roof. I have had various roofers and various 'remedial' works carried out, and the issue with the roof has now finally been resolved. The remedial works involved them cutting out a section of my ceiling, which has recently been repaired and the hole filled in with new plasterboard. However they are not willing to repaint the ceiling- saying that it is classed as internal redecoration- which is excluded in my tenancy.

Am I going mad?? The whole reason the ceiling needs re painting is coz of a building defect!! I would like to be put in the same position I would have been, if it weren't for the roofing issues. I think Im right- no? Afterall, Im not asking for it to be re-decorated coz I fancy it in duck egg blue..............

Any thoughts would be welcome.

    Paint it whatever colour you fancy. Tin of vinyl matt or silk and a cheap roller.
    Use some old sheets to prevent any spatter damaging your furnishings. Couple of hours, job done.

    The HA are only responsible for maintenance and fixing problems, which they have done. As they say, you are responsible for internal decoration.

    If it really is a new build defect that occurred in the defects liability period though, the builder should be responsible.

    Check their quality standards for letting accommodation and the standard to which you have to maintain the property when you return it.

    If it says in there that undecorated plaster is not acceptable and/or that walls and ceilings must be painted, then ask them to finish their repair to their own quality standard.
    A kind word lasts a minute, a skelped erse is sair for a day.
