Offered cancellation by hotel... agent only refunding part of it

Hi all,

After some advice/guidance.

Had an email from destination2 on the weekend advising they've been contacted by our thai hotel advising the pool will be out of action for the duration of our trip offering option 1 - free upgrade to half board or option 2 - cancel the booking.

I've tried to work with d2 to find an alternative hotel but their price on the other one we want is not competitive. So I've opted for option 2, cancel altogether.

D2 are now saying the refund will be approx £154 however we paid £180.... where do I stand as it isn't me who has initiated the cancellation (offered voluntarily by hotel) and the product (hotel) is now materially different to the one I booked - as there will be no pool facility. I can see on original invoice that the difference is agents fees.

    As you didn't book through the hotel I guess you will have to pay the agent's fee

    What are the T&C's of the booking?

    Even if they state the agent can keep the fees-regardless-they could be deemed "unfair" so you could take them to court to recover:eek:
  • It's no more the agents fault than yours that the pool will be unavailable. Do you think they should work for nothing?

    Did you pay in foreign currency?
    If so it might explain the discrepancy between £154 and £180.
    (eg you pay say $500 they refund $500 you lose out as a result of buying and selling rates for that currency)
