VCS card left on car

Noticed a lot of info flying around about VCS and validity of their myparkingcharge but remain confused as to what to do in this particular case.....

A ticket was placed on the windscreen of vehicle directing driver to the site (thats if you have internet that allows you to dodgy sites) which the driver was unable to do due to lack of net coverage.

6 days later a NTK was received quoting Contravention code 82 - parked after the expiry of the time purchased.

Made contact in writing to ask how this was so and if they had a photo of the pay and display ticket. And who gave them permission to get my details from DVLA.

No response has been received. Further letters have since been received from DRP on behalf of their client.

The reason asked if they had a copy of the P&D ticket is that they marked on the date and time of the alleged contravention (pleased they did) as the ticket shows that the driver had overpaid by X pence and that the ticket (when you take into consideration the overpayment) did not actually run out for a further 4 minutes AFTER their ticket / card was issued.

So, what to do next? chase them up to appeal (even though they did not respond to my letter sent 8 days after the NTK was received) based on the display ticket bought and their card with date and time stamp or just wait for Court action?

Any advice would be greatly appreciated.

    You can't factor in a random pro-rata overpayment, if you mean the driver did this sort of thing:

    The driver is argued not to have complied with the tariff, can't make it up by an odd random 50p (or whatever) and hope for an extra 20 mins, etc., if that's what you mean. I am not saying the driver was wrong and not saying to pay a scumbag ex-clamper, by the way, we are on your side but paying random extra pennies makes NO SENSE in a contract and does not buy more time.

    Just wait for court action BUT please immediately complain to your MP (and local Trading Standards - NOT the CAB, nope, only TS) about this scam industry (please do):

    We need more MPs and Trading Standards teams primed and aware. What you describe is still a scam, and in particular the fake 'PCN' that says it isn't a PCN is an absolute scandal, goes against the POFA 2012 for notices.

    But the DVLA have swallowed it, seemingly, and said when it was first complained about ''The IPC have told us this is not a Notice to Driver''. Oh, that's OK then, roll over! Of course it is a flippin' NTD, it asks people to pay or appeal when they go online and it IMPERSONATES a parking ticket.

    Grrrrrr...this ''fake'' NTD scam needs to be banned by Trading Standards.

  • surely to bring a civil case they must show they have encountered a loss which they have not if an overpayment has been made. Nothing to say you cannot over pay.

    So what is the best course of action in meantime whilst waiting for court action?

    No, they do not need to show a loss. You are over 2 years out of date in that misconception.
