Getting pre-application advice on a house you don't own?

Hi all,

I'm interested in purchasing a house with a very long garden that I believe could easily accommodate at least one, maybe two, small houses (there is access at the side of the house). The neighbours all sold off their gardens 15 years ago to a developer and there is now a housing estate overlooking the garden. It's hardly a picturesque spot, and one house a few doors down has already built 2 houses in their garden, so it wouldn't be an unusual thing for the area.

How do I go about finding out from the council whether it is likely permission would be granted? Is pre-app advice even an option on a house you don't own? I would rather do this on the quiet as I don't want the seller getting wind of my idea in case it makes it hard to negotiate.

I know the local planning policy fairly well and I don't think it would be much of a problem (doesn't go against the normal grain of development etc), neither is it in a Conservation Area.

    Yes a pre-planning enquiry would be your best route to understanding the feasibility.

    You do not need to be the owner, in fact you do not need to be the owner to submit a full planning application.

    Pre-planning is not made public so the owner of the property would not know. Make sure the correspondence address is not the same as the site address and make sure your architect or whoever is applying calls the council upon receipt of the application and insures the situation is explained which will avoid the case officer visiting the site etc.

I know you don't have to be the owner to submit a full planning application, but you do have to submit a certificate that says that you must have given notice of the application to the owner. I know because I did it recently on a friend's garden to try to get permission to build.

    Thats correct that you need to notify the owner for a full planning application but you do not need to do this for a pre-planning application
