IPC PCN overstayed not sure to risk

Options
Hi,
Got a PCN from overstaying (somewhere between 15 and 25mins), fined £90 or £45 if i pay in 14 days (deadline is tomorrow) theyre an IPC company 'Premier Parking Solutions' and I can see last year they took 39 cases to court out of 12000 cases (so roughly 0.3%).

I had a ticket but threw it away since, whats the best advice? My main worry is my credit score getting affected if I do get taken to court. Anyone else dealt with PPS?

I have read the Newbies post but i found it pretty hard to follow in the case of IPC's.

Thanks

    in simple terms then

you appeal to the PPC using the black text IPC template

then you IGNORE for 6 years unless they issue an LBC or an MCOL by post

you IGNORE any DCA letters too

if a court case was to happen :-

if you lose , pay the judgment , promptly
    within 28 days anyway

this means there is NO EFFECT on your credit rating , as the matter is deemed "satisfied"

it is IGNORING A COUNTY COURT JUDGMENT that leads to a CCJ after 28 days and therefore it is this live CCJ that trashes your credit rating

so as long as you paid up IN FULL if you lost , there is nothing to worry about

its the fools that ignore the judgment that end up with a CCJ and a trashed credit rating

the "BEST ADVICE" is to get the landholder to cancel it !! there is nothing better

Hard to follow because there is no next step? That's because there is no next step...

You can search the forum for 'IPC ignore all the same' and you get hundreds of replies:

All the same! Get on with your life, come back if you get a claim.

its certainly one weay of doing it , but even if you sent it in before day 21 , they will still reject the appeal

in other words, almost all appeals are rejected because there is no money in it if they accept the appeals, they only want your money , as much as possible

so yes you can wait for the NTK between day 29 and day 56 (assuming there was a windscreen ticket) and then appeal it as KEEPER (not as driver) using the black text template appeal

after that , IGNORE the fools unless they try court
  • awesome, thanks for the clarification. So doesnt really matter when i appeal, its just a technicality.

Is my appeal basically a way to make them give up as they know I'm not gonna go down cheaply?

With IPC you can ignore them if you prefer, that's what the BMPA advise. Both are valid. The appeal suggestion, is not designed to make them give up, they will not.

    It's purely to:

    - look reasonable if they later try a small claim (shows you didn't completely ignore it)

    and

    - to communicate that you are on this forum and maybe they might pursue another victim for their odd pot-shots at court.

Up to you. Appeal or don't bother. Enjoy collecting the threatograms.

Nothing to give a second thought to really, except to complain to your MP about this scam industry (please):

We need more MPs primed and aware.

Just where does this nonsense come from? Was it a good friend, work colleague, or the ubiquitous 'man down the pub'?

Research is key before letting hysteria set in. I could understand it if Google wasn't instantly at the fingertips.

Playing totally into the clutches of the PPC.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

no , its just to show any judge in the future that you disputed the invoice

they wont "give up" for 6 years because that is how long they have to issue a court claim using MCOL
