How best to appeal?

Estates Manager for the store has with:

Thanks for the copy ticket which shows an issue time of 06.38. Can I please ask who the driver was as we might recognise the name and if they were with the car when the ticket was issued?

Say that the name of a driver should never be divulged to private parking scammers, but if they promise to NOT share the information with their rogue parking agent (sharing such personal data being against the DPA and specifically NOT authorised in this instance under any circumstances) the driver will be named just to them.

But add that (if true):

...the flooring has not yet been purchased so the name will not match a flooring purchase yet (and will not at all if this scam is not cancelled).

The Estate manager has replied with:

I was just wondering whether the driver was with the vehicle outside our Cheltenham store at 06:38 on the 28th June when the unauthorised parking was recorded and what they thought our opening times were?

If the driver had been with the vehicle, they would probably have noticed someone putting on the ticket.

The driver was presumably saddened by the "part-timers" not opening their store until the best part of the day had gone ( unlike some stores, which do open that soon ) ; and bored by the window display, so went to stretch their legs and work off their frustration.

The Ts & Cs claim that the penalty charge would apply, even if the driver had been by the car, or by the door of the store, or walking between them ; so it is clearly wrong. It is therefore no more applicable, if they are in neither of those places. If the sign had said something to effect of allowing customers to walk across the car park, or wait in it for a few minutes before the store opens, the questions would be relevant ; but the time for reasonableness, was when the sign was being written.

He thought the store opened at 7am and was waiting, as far as you know, either with the car or near it, and certainly was not expecting to be fined for being early.

When I was a teenager, my Dad would go off to work early. In the evening, he would ask me what time I'd got up. Whatever answer I gave, he always replied, "I'd done half a shift by then". He would be very scathing of a 7.30 start.

Our opening time at the Cheltenham store is 07:30 and that is normally to accommodate traders rather than retail customers but if you like I can ask VCS for details of whether or not anyone was with the vehicle at 06:38 when the parking contravention was timed. Can you please confirm how long the car was parked so that again I can check those details with VCS?

After a lot of emailing back on forth with the Estate Manager, I eventually got the ticket cancelled when the Director of the Property got involved.
