Smart parking. Parking ticket

Hi I have received a parking ticket from smart parking Ltd for the date of 13/07/2017 at 21:04. I didn't have any change on me so I down loaded the RingGo app and paid via that I paid £1.40 for 2 hours parking. On the PCN it states I parked up at 21:04 and left at 21:21 when I entered the car park I got out read the pay and display sighn and followed the instructions to down load the app and pay by the time I did this it was 21:09 and I have an invoice to prove I have paid for my parking, surely I should not off been issued this PCN as it takes time to down load the app and register and enter card details. Any thoughts on this please

    Please read the Sticky thread for NEWBIES then appeal using the BPA template in blue you will find there. Copy and paste and send. Do not reveal the driver's identity.

    If/when they reject it, you will need to read up on how to beat the scammers at PoPLA. One of your PoPLA appeal points will be lack of grace periods which is a breach of the BPA CoP which states that parking scammers must allow two grace periods. One at the beginning and one at the end of a parking period.

  • Hi if you mean the hotel it was on they said its nothing to do with them as they have sold the car park to smart parking

    sounds like a pack of lies to me !!

    the landholder may have employed not so smart to manage the parking , but I doubt that not so smart actually own the land

    Fruit I am thinking this will be the basis for my POPLA appeal but what exactly are the grace period durations?

    They are in the BPA CoP. You need to look up the latest version (I think it is 6) and see what it says then quote it back at PoPLA. Post your draft PoPLA appeal on your own thread for the experts to check before you submit it.

    Is Smart Parking saying :
    a) They have no record of the RingGo app payment, or
    b) They agree it was paid, but too late ?
    That determines which defence is best.

    21:04 "the driver" arrived
    21:09 someone paid for 2 hours of parking
    21:21 "the driver" left
    That's 17 minutes of parking by my calculation.

    Is smart parking saying that 21:09 is too long after 21:04 and if so, how long do they allow ?
    For any accepted form of payment, ( coins / RingGo app ) they should allow a suitable time ; else any driver entering the site, would be immediately subject to the penalty charge. Some parking areas allow "normal" payment up to 24 hours after the event.

    Grace periods are allowed "free parking", so if you pay for an hour, you can stay 10 or 20 minutes longer. In this case, the driver paid for 120 minutes, but only used 17, so we don't need that defence

    I agree with Geoff above. If they are saying that 5 minutes is too long to set up and pay RINGO then grace as such does not even come into it If you could answer his points, it would get helpful.
  • I'm still waiting for correspondence from them. i have appealed to them via there website and emailed them. So just waiting for the out come my argument is. I have paid, I entered the car park, parked up immediately looked at the sighn to check how to pay, down loaded the app, registered to the app, registered card details and paid. It took me that time to register
  • Hi All I have received a letter from DRP Debt Recovery Plus reference a parking fine from Smart Parking. I have made contact with them three times to state that the machine was not working. Their stated reason for issue - Overstayed Paid Time. As I have expressed on all occasions how could I have overstayed my time if I did not purchase a ticket the machine was broken. I have now received a final letter stating that they will take court action. How can I fight this with Smart Parking/DRP
