Do I have a case for the damage to my phone?

Hello,
I'm hoping you'll be able to advise on whether I have a case for some quite considerable damage to my IPhone resulting from the use of a Spiglen cover. I bought the case around 6 months ago and now have little scuff marks all over the matt finish in some cases these go right through the paintwork. To me this is a serious failure of the device given it is supposed to protect the case but has instead caused damage. I'd have been better off not using it.
I contacted Spiglen identifying the problem on the online contact stating that the cover had caused said damage and I expected my phone to be replaced or in the least repaired I have since provided photos and had two responses, chain as follows:
1. My initial contact
2. Request for photos
3. I provided photos (Would love to upload them on here, but not sure how...?!)
4. Spiglen response:
Dear Matthew,
Thank you for providing us with the close photo. We are sorry that it happened to your device, however this has nothing to do with the Airskin case. It's made from soft polycarbonate material, which cannot make that harm to the device.
Please note that scuffs are created not because of the case, but because small dust particles get under the case. And they do scratch the phone.
The best we can offer in this case, is a discount to any new purchase from our store.

Hi,
Thank you for your response. I'm afraid I disagree, you're product carries no warning regarding such dust particles causing damage to the phone or any indication of how to avoid it.
The phone cover is designed to protect the phone, whereas it has instead created an environment that causes damage. In which case I would be better not using the product.
The fact that you are willing to offer me a discount on your products indicates that you are accepting some blame and compensation for my issue. This is insufficient.
I expect compensation to replace my IPhone 7 as a result of the environment created to damage my phone or compensation to repair the unit.
This damage would not have occurred without using your product.

Many thanks for your e-mail.
However, as it was previously advised, we can confirm that there is nothing to do with the AirSkin case. It may happen not only from our cases, but from all polucarbonate cases that affec tthe phone in this manner. Please note, scuffs are created not because of the case itself, but because of the small dust particles get under the case. And they do scratch the phone. In order to avoid it happening, it requires clearing of the case and back side of the device from time to time.
As it was previously advised, the best we can offer in this case, is a discount to any new purchase from our store.

I have not yet responded to the as I can see the circle we are about to enter into. Any ideas what I should do next? Any help would be amazing. I know little scuffs can appear but these are everywhere and i've now shown it to quite a few people and all agree that it is not normal and really bad.

You need to pay for an independent report to prove your damage has been caused by whatever you claim .
Who did you buy the case from ??
The fact that they are willing to give discount means nothing any complaint usual gets that sort of offer0 -
you're product carries no warning regarding such dust particles causing damage to the phone or any indication of how to avoid it.
The dust particles must have been in the environment where you used, carried or stored the phone. They didn't supply the dust, it's yours.
I remove the gel case on my phone occasionally and remove any dust ingress.0 -
Is the internet awash with complaints these cases are damaging phones? Are the reviews of these cases saying so? I can't be bothered to check but if you can't find anything then your claim is very weak. If there are a lot of complaints then it goes a long way to proving your case (no pun intended).0

Surely when the phone is in the case then you cannot see the back of the phone, scratched or not.0

It did seem a bit of an overreaction. Given the reviewer's response to a fairly trivial bit of damage I guess I should be in long-term therapy after what my sprog has done to some of my stuff:
- pushed the TV off the cabinet - the picture had a sickly green tinge afterwards but it hung on for 6 months before expiring.
- scratched the screen on my iPhone
- trod on the screen of my Kindle Fire and cracked it, though it is still working 3 years later.
I bought a new laptop this week so I decided not to tempt fate and purchased the additional accidental cover for an extra £35 as the sprog now does "computering" at school.0 -
