Hi guys,
My first post on here but I hear that this is where heroes don't wear capes
Note: I have had a look at the Newbies thread (post 2), and have done the initial acknowledgement of service with a "I intend to defend all of this claim"
Now, I need to put up a defence which I need your help with
More details about the claim as follows;
A claim was issued against you on 12/07/2017
Your acknowledgment of service was submitted on 22/07/2017 at 16:23:32
I believe I have 14 days after 12/07 (+5) to submit my defence, so 1st August?
The particulars of claim are as follows;
Claim for monies outstanding from the defendant, as registered keeper, in relation to a Parking Charge, issued 30/03/2017, for parking on private land in breach of the terms and conditions (the contract). ParkingEye's automated number plate recognition system, monitoring <<Location>> captured vehicle <<Registration>> entering and leaving the car park, parking without authorisation. The signage, clearly displayed at the entrance to and throughout the car park, states that this is private land, is managed by ParkingEye Ltd, and authorisation is required to park, along with other T+C's by which those who park on site agree to be bound. In accordance with the T+C's set out in the signage, the Parking Charge became payable. Notice under the Protection of Freedoms Act 2012 has been given under Sch 4, making the keeper liable. This claim is in reference to the Parking Charge(s) <<ID1>><<ID2>>.
Amount Claimed: 100.00
Court Fee: 25.00
Legal rep costs: 50.00
Total amount: 175.00
Your help would be greatly appreciated on this one guys.

the AOS online extends the defence submission period from 14 to 28 days , so 28 days after the date of service (or possibly 33 days after the letter date)
5 days for it to activate + 28 days if you acknowledge it promptly
now you need to draft a BPA type of defence , based on either 2017 PE defences on here (or on pepipoo forums) , OR based on other BPA member defences like CEL , or UKPC , or PREMIER PARK etc
draft it , post it on here for critique
ps:- nobody will write this for you, but once you do the legwork and post the draft people will look at it0 -
What was the location? And scenario? And did the driver appeal, or the keeper?
The claims talks about parking without authorisation, so can it be argued that's not the case?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It was in a business park, but one of the areas (which the car was parked in) was reserved for a hotel. I had no idea until some time later when receiving the letters (which were ignored due to previous advice on private parking companies) - therefore no appeal. I'm not sure this will help the case, but are there any further grounds to defend on?0 -
You need to defend it like other cases you will find here. Plenty of examples linked in the NEWBIES thread, post #2.
Also search this forum for keywords like 'ParkingEye defence Hotel' or 'ParkingEye defence authorised' or 'ParkingEye defence permitted'. Read only RECENT 2017 defences and use them to put together a draft for us to help you improve.
