Parking eye Notice to Keeper

Yesterday I received in the post a Parking Charge Notice from Parkingeye. This was the first I knew of an infringement, as a yellow (or any other colour) sticker was not issued.

The vehicle was parked in Morrisons car park in Redcar.
This car park used to be Pay and Display (ticket and redeem charge in Morrisons with your shopping). However, a while ago (more than 12 months) Morrisons (I presume) put black plastic bags over their pay meters and sellotaped notices onto them saying parking was free. The black bags are still covering the payment meter but the notices are no longer there.

It was presumed the same rules applied, but apparently Parkingeye are now monitoring this car park. They have stated in their letter the following: "...a Parking Charge is applicable if the vehicle remains in the car park for longer than 3 hours 0 minutes max stay time. The signage also contains further terms and conditions associated with this car park by which those who park in the car park agree to be bound."

The maximum stay is 3 hours and my car was there 4 hrs 18 mins. If there had been the option to pay for a ticket, I would have done. If it was made clear this was a maximum stay car park, I would have adhered to that.

My questions are:

Can they issue a Parking Charge Notice without the yellow sticky thing on my windscreen?

As the vehicle was parked 1 hour 18 mins over the maximum stay, and nobody in their right mind would overstay that long if they were aware of the penalty, a defence?

Or should I just pay it. £50 if paid by 1/8/17 or £85 thereafter.

Would it help an appeal if I told them I was disabled (no blue badge) and at my first day of a volunteer charity position with the hope of returning to employment? Lol I doubt it!

    Thanks Quentin, I did read the newbies bit, but it never mentioned what can be done if you never received a yellow sticker thing on your windscreen.

    I am going to take some photos/video of the signage and try to get as much evidence together as I can.

    Morrisons will cancel this.

    Actually it does, but it will take you several goes to understand the ins and outs of how the unregulated scammers work and what you need to do to beat them.

    Please do complain to the CEO however as this has never failed to get a charge cancelled as far as we know.

    If it was PE, then probably it was ANPR. If so, they have only 14 days to get a NtK in your hands, so..... date of contravention and date on NtK please.

    We will help you, but I do think you may have been slightly freeloading using Morrison's car park for over 4 hours when you were probably shopping elsewhere. Probably why Morrisons brought in a PPC.

    That aside, please give us the dates in case PE have boobed.

    Don't be ridiculous and stop looking at the first 14 day 'deadline' bribe. You will not be paying a penny to this nasty, aggressive company.
