Should my new slate tiles have scratches?

I've just bought some slate wall tiles for my bathroom and around 1/4 are scratched. Some are only the length of a thumbnail, some look like a cat has scratched them. The supplier says this is natural and won't accept them as faulty. Does anyone know if this is true or are they pulling the wool over my eyes?

    Slate does scratch easily. Have you tried a bit of oil on one of the tiles? I'm sure I used vegetable oil on our slate hearths when they were all scratched and it sorted it out.
