I appealed a PCN recently from Civil Enforcement because it was sent to me outside the 14 day timeframe for ANPR (2 months over). The have refused my appeal because "there is no reference to POFA on this ticket". It is private land but do they not have to follow the POFA regulations? as they are saying my interpretation of the Act is incorrect?

providing you have not named yourself as the driver they would struggle in court , have they issued a POPLa codeSave a Rachael

A short reply stating that you agree with them.
- They may pursue the driver.
- It was not you.
- They have lost their right to pursue the keeper.
- Good luck in finding who was driving but as it was so long ago, you are unable to help.
- But you will be most happy to pursue this argument in court

They are right - clearly all of that is true - but they are stuffed, that's the whole point of appealing as keeper! :rotfl:
You win at POPLA, copy another CEL POPLA appeal and they will skedaddle. Do not ignore it, they sue people, POPLA will kill it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
