I'm not a solicitor, but speaking with the family seems sensible - even if you could win more if you took formal action, assuming your losses are fairly small then getting it resolved with minimum cost in £s and time/stress would be sensible. If you were going to replace anyway, hopefully you can agree a sum which is less than the cost of new items (these were secondhand) but enough to leave you feeling better off than if you were paying the full replacement cost yourself.
It sounds like it was an honest mistake (at least on the previous owner's part): I'd imagine they got little or nothing from the clearance company. Bearing that in mind, it would be nice if you could settle amicably!0 -
Thanks everyone. We'll talk with the vendor's family and see what they say. We don't really want to make to much of a fuss about it as we were going to get them replaced, but they would have tided us over in the meantime (especially that garden furniture!)

Don't underestimate the costs of getting a different washing machine plumbed in and set up. It might be an easy swap or it might not be. I speak from experience. And do remember that most washing machines weigh a ton. It's a lot easier hauling an old one out that you don't care about, than it is carefully putting the new one in; chances are the old one was a good fit and was also balanced and levelled.
There's sometimes more to it than just lumping the next one in where the old one used to sit... and it's a lot more fiddly if it's a fitted kitchen too.

It sounds like an honest error, if the vendor was elderly and is now going into some kind of assisted accommodation then the family will have had loads of stress and hassle in making and implementing this decision, especially if more than one relative is involved. It's not like they've deliberately profited from taking the items (they've in fact incurred unnecessary costs with the clearance firm!).
Prepare a list showing prices and delivery for mid-range second hand items and say you understand it's been a difficult process for them, and that as skint FTBs you just need some functional basics to keep you going. No need to mention solicitors or small claims courts at this stage.They are an EYESORES!!!!0 -
Basically what has already been said - but remember you must mitigate any losses.
So don't go buying brand new and claiming the full value0 -
Just a quick update on this. The vendor's family have been more than generous and have given us a large sum plus goodwill payment to help us purchase replacements (they even priced up replacements for us too!). We didn't expect this at all and as FTB it was most welcome indeed. Just goes to show what a friendly message can do0
