Parking eye aire street

Hi, a vehicle owned by me has recently received a £100 fine through the post from the named company for a 14 minute stay in the car park. When the person entered the car park there were only a handful of cars this was approximately 19:10 with numerous car parking spaces by the time they pulled up and gone over to the pay machine and read the costing for an hours stay (which showed as £5.50 as after 18:00 and at wknds they have flat rates which they didn't know) They decided to pay but no card facility, they then went back to the car to try and pay over the phone but their card wouldn't be accepted. They then decided to drive out of the car park and try and find another spot in the area to park which in all took around 14 minutes. Is this fine way over the top as they didn't cause them to lose any business with the time of evening it was and should an appeal be lodged?

    Search for ParkingEye Aire Street. Plenty of examples for this spot.

    AFAIK there is an issue with their contract with the occupiers.

    What you describe is the same as 2 or 3 other Aire Street cases we have helped people win at POPLA appeal, with certain wording. Their clarity of signage, the scratched/unreadable old machines and the stony pot-holed road surface inside the site, all add to the time taken to manoeuvre in and then out, having read the signs.

    Search for 'Aire Street POPLA' and read the recent winning threads. Base your POPLA appeal on those, at that stage.

    Utter con at a run-down car park, of course you must appeal and not pay. Do not write your own first appeal, take it from the NEWBIES thread and write as the keeper.

    Did the PCN arrive within 15 days??

    Yes the fine was received around 9 days after the incident I've also been and taken some pictures today of the state of the car park still and a few signs that have overgrown greenery on them. This plus the fact the first point when you drive in off the main road you have no time to check the boards to even know this is an ANPR site as you will hold traffic up behind you while reading through the confusing payments on weekends.

    its not a "fine" , its an INVOICE , nothing more

    PE cannot "fine" you , or the driver , or anyone for that matter

    it wont even say the F word anywhere on the paperwork , it will say Parking Charge Notice

    the F word is a legal term that does not apply in this case

    its good that you have taken pictures for evidence

    it also seems that they have followed POFA2012

    appeal on the PE website as KEEPER and use the blue text appeal

    then start drafting a popla appeal for popla , when PE reject the appeal and issue a popla code

    Can you show us all those pictures as a link (in Dropbox or similar)? They would really help as we get Aire Street cases like yours all the time.

    A nasty cash cow, and a nasty site in every way, very unwelcoming and expensive and pot-holed. And as IamEmanresu says, the landowner/occupier contract is dodgy, from those we have seen.

    If there's a standard 10 minute grace period for a correctly-working payment machine, this seems to be a scam along the lines of :
    "I'm sorry your card hasn't been accepted, let me just try it again a couple more times, while I watch the ANPR cameras clock up your parking duration, until it's long enough that when you leave without paying ( or usefully parking ) I can charge you £100 . . . "
    DING
    "No I'm sorry, I can't take payment, you'll have to go somewhere else."

    With me being a new user it won't let me submit links here so just put http before the link I put to see the images.
    I've sent the above to ParkingEye and they have come back with an unsuccessful email saying as a good will gesture they now give me 14 more days to pay the reduced sum but have given me a POPLA number if I want to go ahead and challenge it.

    Search for ParkingEye Aire Street. Plenty of examples for this spot.

    There is no goodwill, don't read their stupid demand and worry that it's a bargain & rush to pay.

    No-one folds and pays here, only an idiot would pay.

    We even have pre-written Aire street POPLA appeals, all you need to do is - of course - search the forum for 'Aire POPLA'
