smart parking fine not full reg

Options
So, havig purchased a ticked for 1 hour and only stayed 11 mins i have recieved a parking notice from Smart Parking as my ticket only shows the last three letters of my reg number VOP . Luckily I kept the ticket which shows it was purchased 1 min after i was photographed entering the site. Smart Parking turned down my appeal stating i should of entered the full reg as stated so i have now sent photographic evidence of the ticket and notice charge photos to POPLA....what do you all think to my chances of winning..im quite happy to go beyond popla if they dont side with me on this as its the principle of the thing. thoughts?

Get stuck-n to the Newbies Sticky and form a proper defence - PPCs and POPLA don't really do fact, so you need a stronger challenge.

If that's all you've sent/appealed on to POPLA, I'm afraid you're likely to lose. Sorry.

But unless Smart issue a LBC or MCOL (see NEWBIES FAQ sticky, post #2) you ignore anything else. They have 6 years to issue court proceedings, but at present they are very quiet on the court front - this doesn't guarantee how they will behave in the future.

they would say that though , wouldnt they

mistakes happen , and judges know it

A judge may decide that as payment was made that SMART accepted a new contract at the point of sale, that their machines should not allow any incorrect VRM not seen by their cameras to be input , or that a choice chould be presented

this topic has been debated many times on here and on parking pranksters blogs

so if it fails at popla, IGNORE the DCA letters and if they want to try court then take them on

keep that paid for ticket safe , because its your part of the paid for contract

A wasted opportunity for an easy win on first appeal. Next time play it as per the NEWBIES thread. Smart would have cancelled.

Never mind, win or lose at POPLA, you won't be paying Smart.

In fact recently, Smart have issued a few claims for the first time this year, so don't ignore it if you get one. In the cases we have helped with a defence statement, Smart have discontinued.

All you needed was a template appeal from the keeper and you'd have won at the first stage. Next time!
