Indigo Parking - appeal denied. Please help

I received two parking tickets back in May for not having a valid permit on display whilst parking in a train station car park run by Indigo Park Solutions. It was a disabled bay and I did have my disabled badge on display but Indigo are claiming that there was clear signage to state that these spaces are reserved for Prestige permit holders / Staff / Permit holders only. (As it happens the signage is really poor, I remember checking it first).

Anyhow, as recommended, I appealed the tickets with the suggested letter outlined in the pinned thread, to which Indigo have just come back with the below letter via email.

What should my next steps be? Appeal to POPLA? Or just pay the £60?

Thank you for your correspondence in relation to the above Penalty Notice.

Indigo Park Solutions Ltd operates as an AOS approved operator, in accordance with the British Parking Association Code of Practice for private parking. When parking on private land, the onus rests with the motorist to accept and to comply with the land owners Terms and Conditions of parking.

On the date above, you chose to park your vehicle in breach of the Terms and Conditions of parking which are displayed at the entrance to the car park.

Breach Code 2: Failing to display a valid permit

Having reviewed the photographic evidence which is also attached, there is clear signage to state that these spaces are reserved for Prestige permit holders / Staff / Permit holders only. It clearly states in the Terms and Conditions by entering the car park you are agreeing to park in accordance with the Terms and Conditions and it is the customer's responsibility to ensure they observe the Terms and Conditions before leaving their vehicle in the car

A Penalty Notice may be attached to your vehicle or sent to the registered address of the vehicle if your vehicle is failing to display a valid ticket

Having reviewed the circumstances surrounding the issuing of the above Parking Charge Notice, and having considered your reasons for appeal, our decision is to uphold the Penalty Notice.

Please note that should your appeal to POPLA be unsuccessful, Indigo Park Services UK Ltd reserves the right to pursue the full amount outstanding as stated on the Penalty Notice, plus any additional associated costs in accordance with our Terms and Conditions of parking. by law we are also required to inform you that Ombudsman Services (https://www.ombudsman-services.org) provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service.

As such should you wish to appeal then you must do so to POPLA, as explained above.

    so appeal to popla , as separate appeals for each ticket (you should have 2 popla codes)

    if you plagiarise other peoples work it wont take long to knock up a popla appeal , especially as bylaws apply

    appeal to popla around 26 to 28 days after that popla code was generated, because you are trying to string it out past the 6 month deadline for magistrates court (not that the TOC ever do mag court)

    if you really want to do more research , put INDIGO RAILWAY POPLA into the forum drop down search box and look at anything from this year only

    at railway stations BYLAWS over ride private parking companies ideas , and as far as I am aware "Breach Code 2: Failing to display a valid permit" is not a bylaw offence

    look thru postings (INCLUDING completed cases) for bylaw - indigo , as such if the POPLa appeal is clearly marked as BYLAW case , it will be put on hold or rejected (dependent on full moon or not)

    use your code wizely , you have got one because they think you are nieve and will !!!! up

    NOTE carefully the date issued , and the remaining time to submit , IF you get a back up letter from the likes of ZZPS whilst your appeal window is active , or after submitting an appeal , kick off big time !!!


    PS , dont allow indigo to process your POPLa appeal ,

    and remember , each popla code must be appealed separately, even if the appeals are identical apart from the popla code reference and pcn reference

    They've only come back to one of my appeals - I was given two tickets, one each day.

    I appealed both, but they've only responded to the one...

    reply back and ask for the other POPLa code , any ^&&%hit from them , report to DVLA / BPA , I somehow expect you will get a ZZPS letter any day now saying "to late"

    remember in the recent wales / hospital case , many many people complained (online) about not being given POPLa codes , possably one of the reasons for the multi court claim , the BPA know its happening , but wont do !!!!!! all
