Met PCN- late demand for £100

Okay as last posted way back in March the letters from DRP stopped in the early part of this year. Well last week on the 5th August another letter arrived from the idiots, dated 26 July. It was a template letter and basically said that most people pay their parking charges straightaway, it's quite easy to pay (£160), but "if you don't we'll recommend to our client that they take court action against you".

Straight away I wrote another letter to the Mc Donald's HQ repeating a request for assistance made to them last year and complaining about the tactics of MET Parking Services. Yesterday a letter arrived in a brown envelope, it was our address but someone else's name. We opened it to find out who sent it so that we could return it and, surprise, surprise, it was from DRP again. It had my PCN number, the correct registration number and Mc Donald's location. It went on to say-

"Dear (other person) we would like to apologise for a letter that was sent on 26/7/18 for the PCN listed above, this was sent in error and this charge has been cancelled"

I thought it would give some people a bit of amusement, the message is - Don't give up, be smarter than them, make them work, complain to the client company and hit them where it hurts. The next step is a SAR!

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Quite correct, many thanks for the 'heads up'. We have two cases going with two parking companies, I'll delete and post in the other case on this forum. We are still waiting to hear back about this MET case.

    The saga continues.
As I said above DRP sent a letter in August saying that the charge had been cancelled, I then filed an SAR and MET Parking responded with A4 copies of all the letters sent to me and the POPLA appeal stuff. What they didn't send was a copy of the August letter so I emailed them back and asked for confirmation of the cancellation so that I have a complete record before sending in a request to delete all my personal data.

They responded by saying- "There is an appeal registered to your case which is still under investigation. Once the appeals department reaches a decision, they will notify you."

I emailed back- "I think that you are confused. What appeal are you referring to as your SAR response does not refer to any ongoing action? "

    They responded 22 October-
"Thank you for your email, as advised in our letter of 6th September, your appeal to POPLA was rejected and therefore the case remained outstanding and payable. As you have not paid the charge notice the case was passed to Debt Recovery Plus for collection and remains outstanding and payable. For the avoidance of doubt this case has not been cancelled.
    Debt Recovery Plus, they can be contacted via the following methods;
    "

Yesterday I got a letter from dated 24 Oct, it's identical to the one they sent in July requesting £160.

I'm at a loss to know what they are playing at as the August letter sent to my address and with my registration number and the correct PCN number (but with someone else's name, said-

"We would like to apologies for a letter that was sent on 26/7/2018 for the PCN listed above, this was sent in error and this charge has been cancelled."

I would email Steve Clark at the BPA to investigate, show him the August letter too:

Yes but the whole point of an SAR is to get a complete picture of what they hold about you and then request that they delete it. In this case although they sent the letter that clearly cancels my PCN number, they are still pursuing it, so even if I hadn't asked for confirmation that the charge had been cancelled it would leave the door open at any time in the future for them to claim payment or go to court. I want the whole thing wrapped up and put in the bin for good, so that's why I need confirmation from them that the case is dead if you see what I mean.
