Someone fell through my garage roof

A lad of around 25 years old went on my roof to find his drone. I here a crash go outside unlock my garage low and behold there he is stuck in my gagrge and massive hole in the roof.
We have rang our insurance today who state it's accidental damage which we don't have cover for.
How can someone trespassing on my garage roof and falling through class as accidental damage.
While it's hardly a crime worth noting it seems we have other option but to report it to the police in order to get a claim pit through which seems stupid to me
Anyone else had any experiences like this and got any advice

If this is simply trespass then the police won't be interested.
You can sue the trespasser directly - though maybe that will be unnecessary if he agrees to reimburse you for the cost of repairs0 -
1. Is the person concerned (largely?) okay?
2. Have they not offered to pay? I have in similar (less daft on my part) circumstances.0 -

Someone falling through your roof is, to you, accidental damage (a sudden and unexpected event).
You could appeal to insurers better nature and ask them to treat it as malicious damage or vandals.0 -
It's his bill. Get some quotes and open up the discussion with him over paying. If he doesn't pay, take him to court through the small claims court.
You shouldn't have to pay for his hobbies and his poor choices.
He's also not "a lad" - at 25 he is a fully grown adult. Indeed, the body/brain stop growing at 24. He's old enough to have joined the army, fought wars, left there, started a family, bought a house .... and be looking at pension plans.
He shouldn't be arbitrarily choosing to traipse over people's garage roofs.0 -
By all means try but I don't the police will be interested as it sounds like a civil matter:
The offence of 'criminal damage' has not occurred as he had no intent to damage your property (this, incidentally, is why the insurance company are declaring it 'accidental', as there was no intent) and unless you've previously told him to stay off your land (do you have any signs up?) or if you asked him leave and he refused - it's not criminal trespass either.Deleted_User wrote: »No experience, but hopefully your premiums won't go...er...through the roof.A witty saying proves nothing0 -
Trespass would be a tort, rather than a criminal matter.
Try and appeal to the trespasser's better nature and try and settle independently.
If not, small claims' court may be the route to go.
Your insurance is what it is & covers what it covers, and isn't obliged to cover the incident out of goodwill (unfortunately). It may be worth trying to get it put through as malicious damage, but as there was no malice *intended* by the trespasser it may be tricky.0 -
I hope the trespasser doesn't sue you for personal injury. It has happened.0
