Out Of Warranty Goods

Hi hope someone can help me here?
I saw something from Martin about goods being out of warranty by a matter of days/weeks/ months and that goods might still get fixed free of charge.
My sons xbox 360 is three days out of warranty and I have been told by some lady in India that I have to pay £65.00 to have it fixed.
I would rather poke my eyes with pins than pay to have it fixed, I wouldn't mind but we bought the console for my son for Christmas in September so didnt use it for three months but still out of warranty.
Can anyone tell me where I can find Martins tips/comments about goods out of warranty, so I can quote something constructive instead of ranting  and telling them there is no way I am paying for repair?
Cheers DINGER

Where was it brought from? This might help people share their advice better.0

We got it from Tesco but because it was bought over twelve months ago, they said there was nothing they could do for me.0

Ring Tesco customer services (not the store). They will send you an out of warranty form, and no doubt repair, replace or refund the item.Gone ... or have I?0

Have a look on the 360 forums over at www.xbox.co.uk for general moans, groans and what people have done.
MS have a large scale repair program for 360's which have a 'three red lights' fault. If your machine has the three red rings fault it is covered for 3 years from date of purchase, with no proof of purchase required at all and MS will pick up, fix/replace and return for no charge.
If it is any other fault then it looks like you'll have to go back to Tesco's.Anger ruins joy, it steals the goodness of my mind. Forces me to say terrible things. Overcoming anger brings peace of mind, a mind without regret. If I overcome anger, I will be delightful and loved by everyone.0 -
If its the Red Ring of Death (3 Flashing Red Lights) then its covered under the warranty as MS increased that to 3 years for the red ring of death problem.0

This is no help to the OP but this situation is exactly why I always buy things from Costco (assuming they stock it.) If the item breaks anytime in the future, ever, then you just take it back and get instant swop or money back. It's their written policy and they never give you any attitude about warranty or 12 months or anything like that. Getting your full money back on a four-year-old camcorder as I did recently is a funny (but nice) feeling.I ♥ MSE0

Likewise, Boots (online) are great for out of warranty replacement too.0

Just Google the "Sale of goods act" it may well apply0

I second roddydogs! The retailer (Tesco, in your case) has an obligation under law to resolve this situation for you - they cannot palm you off onto the manufacturer.
Three useful sites:
CAB:
http://www.adviceguide.org.uk/index/your_world/consumer_affairs/buying_goods_your_rights.htm#your_rights_when_things_go_wrong
DTI:
http://www.dti.gov.uk/consumers/buying-selling/sale-supply/page8599.html
Consumer Direct:
http://www.consumerdirect.gov.uk/ (You can also call their helpline)
Quote from the CAB site:"If you have had your goods for more than six months when they go wrong, you can still ask the trader to repair or replace them, but you may have to prove that they were faulty when you bought them if the trader doesn't agree. You can ask for a repair or replacement at any time up to six years after you bought the goods (five years in Scotland), as long as it is reasonable for them to have lasted this long. If the goods go wrong after six years (or five in Scotland), you no longer have the right to ask for a repair or replacement."
"If the trader agrees to carry out a repair or provide a replacement, they must do this within a reasonable period of time, and without causing you any significant inconvenience. If you ask the trader for a repair but this turns out to be impractical or to be too expensive, the trader doesn't have to repair your goods, but you can choose to have a replacement instead. In the same way, if you have asked the trader to replace your goods and this turns out to be impractical or too expensive, the trader doesn't have to replace them, but you can choose to have a repair instead."
BTW, my 360 had the RROD a couple of months ago, and I expected to be given the run-around by the retailer (HMV)...However, they were absolutely brilliant - I rang the call centre (I'd lost my original proof of purchase), they tracked down the transaction details, rang the store that I bought the 360 from and then called me back to tell me that a new 360 would be waiting at the store for me. This all happened within 30 minutes or so of placing my first call to them!
Something to remember: If you have game saves on the hard drive of your 360 (assuming you have the Premium bundle), you need to copy them to a memory card, as the retailer will almost definitely want the hard drive back as well as the main console.Mint £869, Virgin £1,403, Create £1,675, More Than £1,533, Capital One £1,290, Mint Loan £10,316, Tesco Loan £3,529, Barclayloan £3,187, GE Capital £150, Barclaycard £190
Currently on track to be debt free in March 2009! (Not taking into account the £2000+ in charges I'm claiming back...)
