UKPC Parking Ticket Clarification

Hi Everyone,

Im just after sonme clarification i am doing this correctly.

I received a windscreen PCN on private land operated by UKPC a BPA member.

I followed your guide for NEWBIES and sent the template letter for BPA members via their online link after 26 days as suggested.

I then received a letter sayin i had 14 days to send the name/address of the driver before they could make a final decision on my appeal. They said a POPLA code would be provided after Final decision was made.

2 days later i received the NTK.

Dates:

Windscreen ticket date 21/05/17
Letter asking for drivers name: 21/06/17
NTK: 23/06/17

Now by understanding from reading the forums is the NTK is now late 33 days had passed since the day after the windscreen ticket. Am i correct in this caclulation?

As i havnt been given a POPLA code do i just wait for UKPC to make a final decision and a POPLA code without responding to their request for the drivers details and then appeal to POPLA based on the NTK being late?

Is this correct?

I checked para 8 of POFA 2012 and my NEWBIE eyes cant find anything wrong with the NTK.

    if a windscreen ticket is issued first (to a driver) , the NTK must be sent between day 29 and day 56 (to the keeper) if the PPC wishes to follow POFA2012

    they cannot apply for keeper details in the first 28 days , whereas for ANPR tickets they have to send the keeper an NTK within 14 days , to arrive by day 15

    so an NTK arriving around day 33 is ok following a windscreen ticket

    just follow the BPA advice in the NEWBIES sticky thread

    and wait for them to issue a POPLA code , once their initial "time out" has expired for the original appeal

    if this fails to arrive , ensure the NTK is appealed with the blue text template on day 26 , as a keeper appeal

    Yes but not about the NTK, you'd be appealing using the other points in post #3 of the NEWBIES thread 'no landowner authority' and 'this case can be distinguished from the Beavis case' (and maybe 'grace periods' if the allegation is a short overstay) and certainly 'no evidence provided that the driver left the site', if the allegation is that the driver 'left the site'.

    Definitely in any UKPC POPLA appeal you will have: 'dodgy unreadable signs' (go to UKPC's website now and copy and save their dreadful, blurred pics of pale signage because you will need to embed those pics to illustrate your POPLA appeal to show the £100 was unreadable. I love UKPC's crappy photos!

    I tend to agree, UKPC ones are not awful these days, so it's a shame they remembered to send one! Never mind, there are other POPLA appeal points.

  • Hi guys im back but with a different username, my previous name was non-compliant.

    So i finally reveived a POPLA Code from UKPC on 02/08/17 with a further rejection letter.

    I was on holiday so have only just received the letter and am now keen to finish this frustration in my life once and for all. Im now researching as per the Newbies thread to see how best to word my POPLA appeal.
