DLA.. moving goalposts???

    I know when I reapplied for my DLA back in January for MH grounds, for renewal to start in September of this year, I didn't submit a care plan. Ok I am seeing a psychiatrist, councellor and my dr on a regular basis but I haven't been given a care plan by either of them. And I never saw one when I was seeing my CPN last year.

    My award came back with an indefinate period this time after being on it for over 5 years now.

    Oh that's excellent news, at least you won't have the worry about renewing your claim for a long while :D

    I'm just going by discussions I've had with others, both MH staff and patients, and it seems there's a sudden trend, certainly in our area, in refusing DLA amongst people who don't submit a CP. Even those that do submit them often receive much lower awards than they previously did, seemingly based on what's written in the CP (most of which only contains basic information).

    In light of this the CMHT here are giving the CP's a complete overhaul and will be including far more detail, along with the type of information/evidence that would be relevant to, and support, a DLA claim.

    It could just be a coincidence, but the evidence is really starting to stack up that you stand a better chance of being successful if you submit a CP. It would be interesting to hear views from other people on this to see if it is a nationwide trend.

  • I don't know whether anyone on this thread is claiming DLA on MH grounds, but something I've recently discovered, which might help a lot of people, is that the DM's are not even considering making an award to anyone who doesn't include a Care Plan from their CMHT.

    I can't remember whether I've mentioned it before but this might well explain why so many people are being turned down lately, so do remember to send in a copy of your Care Plan with your application/renewal/appeal papers etc, and make sure your CPN/OT/SW or whoever you see regularly has got it up to date and includes absolutely everything on it in detail.


    I have just been awarded DLA indefinitely on MH grounds without a CP been submitted. However I did have supporting letters, and have a high level of care from services. I think the more evidence you send the more likely you are to get DLA, so yes do sumbit a CP, just not sure if it does make a difference :confused:

    What if your DLA was for an "indefinite" period? Would my wife have to be re-examined in 2013 for this? She has severe COPD which is never going to get any better, just worse. When she was awarded this it just went through with no questions asked no appeal, just straight through. If they take her DLA away from he what is she expected to do? Work? How? What job? (if there are any jobs). I spend all day from when I get up to when I go to bed looking after her, if I lose my carers allowance I will have to look for a (non existent) job. Who will look after her then?. Also they're around with LHA which could damage us. Perhaps this Government should legalise euthanasia they will save them a few quid, did we all vote for this? Thatcherism by proxy.

    There is nothing new here DLA awards including indefinate awards can be re assessed at anytime.
