Timid poster, advice on technicalities and grace period

Hi there new poster please be gentle,

Writing this on behalf of my girlfriend who received a dressed up invoice through the post today, 100 quid reduced to 60 if paid in 14 days, for staying 3 hours and 11 minutes in a 3 hour car park

I would have to say this is horribly unfair if the grace period is meant to be 10 minutes?

I would also like to ask about technicalities, been trawling through all the articles and forum posts relating to this for the past hour and i Beleive the statement should say if within 28 days we have not received payment, however on our notice it says within 29 days, would that apply as a technicality?

Many thanks would like to know abit more about those bits before proceeding to appeal

Don't - these cowboys don't bother much with them.

Non-compliant NTKs are not a technicality. Instead they are a very real fact of life when dealing with PPCs and should be used whenever they present themselves.

Instead of reading volumes of stuff at random, you need to get stuck-in to the Newbies Sticky at the top of this forum and structure your appeal/challenge along the lines suggested within.

You need to read the BPA and IPC codes of practice. Tell us which PPC and we can say which to use.

The IPC one reads
15. Grace Periods
15.1 Drivers should be allowed a sufficient amount of time to park and read any signs so they may make an informed decision as to whether or not to remain on the site.
15.2 Drivers should be allowed a sufficient amount of time to leave a site after a pre-paid or permitted period of parking has expired.

So you can argue for leeway at both ends.

But can I still use that template but instead of mentioning signs talk about the grace period?

Each PPC deals with appeals differently. Some fold easile others fight to the bitter (court) end.

It's ParkingEye isn't it? 29 days is correct.

But 11 minutes is not OK. No point going into that detail until POPLA stage, though.

Complain to the landowner/retailer. Do that first. Loads are cancelled that way.

No probs, still a BPA firm, and 11 minutes is within the Grace Period you will read about if you search this forum for 'eleven minutes'.

Also, was the 3 hours free, or was 3 hours paid for, and the 11 minutes is either side of paying? If so, how long before paying and how long after expiry of the ticket.

It's 3 hours free parking, no payment taken, entered at 09:50 left at 13:02 duration is classed as 3:11

and complain to the landholder too
