PCP Contract help

Hi all,
I have an issue im hoping you good people on here can help with.
My girlfriend purchased a Peugeot 108 on a PCP deal 3 years ago via a local Peugeot garage near us.
Its due to be given back at the end of august and she will be walking away.

However when she spoke to the sales man who sold her the car (As he keeps pestering her with calls for new 'deals') he mentioned her car had alloys.
But it doesn't, it has trims.

Now I asked my girlfriend, who unfortunately didn't know better, and she said she was sure on the contact it stated the car came with alloys.
Anyway we cannot find her contract to check if it stated alloys were included in the price so we have rang the dealership who have told us they may have 'lost it' or don't have a copy of it.

2 Questions:-
1. What can be done if they have 'lost' the contact
and
2. If the contact does infact state the car came with alloys could this mean the contract has been missold?

Why do you ask if it was miss-sold? Are you looking to get a refund on the payments?

Regardless of what the contract said, given its taken your girlfriend 35 months into a 36 month contract to notice, has it effected your enjoyment or use of the car?

Your bigger problem would be if the garage claim it came with ally's and you're returning it without, they may try and charge you for them...

There is a list codes for the optional extras in my car's handbook, there might be something similar in hers.

Assuming it should have alloys but didn't, then I would have thought there is a case for the purchase price to be revised downwards but presumably the resale value would also be affected so there may well be no overall change to the monthly payments

MMMM I am not sure what you are asking. Do you think that you are about to get a big hand out??? Or are you worried that there will be an issue at hand back.

They will have a copy of the contract they have to. Your partner should also have a copy of the order form. It may be that she was given the wrong car it may be that cars now come with alloy wheels as standard. They may be a lot of reasons.

Either way the vehicle is on pcp so for you to be able to walk away the vehicle must be in fair wear and tear conditions. Within mileage etc. I would be more worried about that. Not trying for one second to be nasty but this is the area you need to concentrate on. Manufactures make a fortune on over mileage and damage charges.

Ok so you need to get a copy of the contract the dealership as I have said will have it.
You also need a copy of the order form again the dealership will have it.
If they are being arsey ask your finance company as they will have a copy of the finance agreement in which the full description of the car would be shown.

I would not, again I stress be to worried as if the vehicle was priced with alloy wheels the residual would of been higher therefore her payments would of been lower.

Either way there are two many if's buts and maybes you need to get the copies and then have a look but please do not expect that this will mean that you get a refund.

Is there not a facility to see the full car specification/options etc if you login/register on the My Peugeot page - https://mypeugeot-uk.peugeot.com/my-peugeot/log-in/#_ga=2.18960881.89763617.1499436892-1236536787.1499436892

For example, BMW have a similar page where you can register your vehicle via the VIN and get the full specification of your car.

1. Nothing can be done. Why didnt she keep a copy herself? Also, what does it matter? Shes handing the car back.

2. No. It means the salesmans got himself a bit confused. I'm going to take a stab in the dark here and assume its an Access or Allure model? They have always just had wheel trims.

Theres no mis-selling. Theres no compensation to be had. Even IF it was supposed to have alloys, shes 35 months in and handing it back in a months time.

Move on.

Your biggest worry if the contract says the car comes with alloys, is that when you return the car without alloys, then you will get a bill for a complete new set. That will be several hundred pounds.

This is the point though. If it was supposed to have alloys and the finance co. are aware and expecting this then she'll likely get a hefty bill post handover.

The odds of a brand new car going out alloy wheels from Peugeot without the factory checks picking it up and after the car being built with the "wrong" spec, getting through checking with the importer, getting through handover to the dealer, getting through PDI at the dealers, getting past the original salesman at the time are pretty much NIL.

Odds of the salesman trying to flog her a new car just making a mistake on the phone? Very high.

Most of these cars sold were entry level Access or Azure models, all of which came with wheel trims at the time - and still do (up to the 2017 ones listed on Autotrader anyway) so the O/P girlfriend would have had to have bought one of the mid / high range cars to have got alloy wheels.
