Article 4/ conservation area/ extractor fan

Hello everyone,

we live midterrace in the conservation area. We would like to get an infill/extension between our and neighbour's current rears, both of which are kitchen and bathroom now. As potential infill/current passage is narrow we've discussed with the neighbours whether they mind to share their wall with us, they seem not to (great!).

However, their extension is higher than ours by probably 10cm and about 10 cm longer and they are refurbishing their kitchen at the moment. They plan to have their extractor fan on a wall that will be an internal wall of our extension. Which I don't think they can without a planning permission or whether it complies building regulations (can fumes intentionally be directed into neighbor's property). Could someone please confirm.

I asked them if they can have it as high as possible so that it stays outside or at least within the roof but not inside our house/future extension. Which architect says wont help us anyway but we will have to lower our ceiling which is 230cm at most now. Our current rear roof slopes towards the middle of our rear. Their's towards the garden. Whilst neighbours are very nice ppl and with common sense all is caused by the their kitchen fitter who doesn't seem to want to direct extractor fan into the roof because doesn't want to touch roof joists (find it ridiculous in this situation).

    it is under construction - the kitchen is there but they are refurbishing it and kitchen fitter would like to have an extractor fan on a boundary wall

    I would be insisting that it comes out the roof or out the rear wall, if they know you are planning on extending imminently it's pretty unfair for them just to bash on with it - have you got a party wall agreement in place? Although it's a refurb they are still proposing to alter the party wall...
    In scotland you couldn't do it but as far as I remember there's no building regs issue in england with it...
    Comes down to being neighbourly - tea, cake and a chat!

    No. It would be classed as a nuisance and possibly a trespass if the extract outlet overhangs the boundary.
