Appealing a parking charge notice 5 months later

Hi guys,

first post one here - desperate.

I had a parking charge notice where i naively ignored their fine and further letters from ZZPS and Hassal Wright. I had the fine in Feb !:eek:

my final letter from Hassal Wright to say next stage is going to court etc. so i think its time for me to take action. I dont beleive the PCN was fairly issued and have asked the CPO for the evidence pack, they said ZZPS have it. I contacted ZZPS who were still happy to take my money but said they could not provide me with the evidence pack, Hassal Wright would. I have contacted them, but they said it is too late for me to appeal now, but have not provided the evidence pack,

is there no hope? are they right it is too late?

what can i do?

    Resign yourself to the debt collectors stage

    Read up the newbies FAQ thread near the top of the forum to learn what is likely to come.

    If you get a lbccA or court correspondence come back for advice your defence

    Tell us who the parking company is and we can give you a better idea as to where this might end up. Don't panic about anything, all can be dealt with - in your favour in most cases.

    This is a well documented ploy of using solicitor headed letters by debt collectors. The Solicitors are in on this insofar as they pimp out their letterheads at a couple of quid a pop.

    As Solicitors, WH take no further part in this. We have not seen any case where WH has taken the lead against a motorist in any county court action. They just let ZZPS use their stationery to exert pressure.

    Just so you know, ZZPS cannot take legal action against you - they have no locus in respect of any alleged debt. The only organisation that could issue court proceedings is One Parking Solution (or their Solicitors). ZZPS work on a no win, no fee basis, so if this ever got to court it would mean ZZPS have failed to get you to pay - and they wouldn't earn a bean. They definitely do not want this to go to court.

    As One Parking Solution have no experience in handling court cases they would be heavily reliant on Solicitors to do the job for them, including appearing in court on their behalf. Total cost to them, especially given their inexperience, would be the chunky end of £300.

    You haven't said what they are claiming, but if it's the usual £100, then you do the math on working out if anyone is going to spend £300+ to recover £100, with a 50:50 chance of losing the case to you, then you being able to charge them ~£100 for your time to attend court and the work you've had to do to defend yourself. In my view, this just isn't going to happen with OPS.

    Again, for information - we can't guarantee this won't end up in court, we can't entirely predict the future as OPS do have 6 years to serve court papers - if they do we will help you with a defence.

    Stop panicking, ride this out. Come back if you get anything else that causes you concern. Definitely come back in the vanishingly unlikely event of receiving court papers.
