Just to clarify DLA hasn't "become PIP". Disability Living Allowance no longer exists, and those who were in receipt of DLA will be invited to apply for Personal Independence Payment (PIP). However this isn't just a change of name; PIP is a new and quite different benefit, with a totally different set of descriptors.
Do have a read of the information provided by members via the links in their responses. You may also want to consider getting some help with your PIP application if you decide to apply; perhaps your local CAB would be a good place to start.0 -
Thanks for the replies. One of the problems is that I was told be the Job Centre that I did not need to get 'sick notes' from the GP any more and that my benefit would carry on as normal. This was over two years ago. So I stopped getting doctor's certificates to send off and everything did indeed remain the same. Although I did keep the correpondence instructing me not to get the notes, is this now likely to come back and bite me in the backside?
I've not heard of PIP and from memory, do not meet the criteria for DLA. I will of course appeal the decision and have already been looking into the best template letter and what info is best to include. I think the biggest hurdles for me are that my illness is one of the 'invisible' ones, where to the rest of the world there doesn't seem to be anything wrong, coupled with the fact that when I do get my occasional 'good days', whilst not in perfect health by any stretch, I can do almost all everyday tasks as long as I don't over exert.
The fact that severe pain and many of my other symptoms are not things that can be measured or seen like a lost limb, cancer etc, seem to to have gone against me, and against common sense when the assessment was carried out. (it was indeed called a 'work capability assessment')
I'll update on here once I have a response to my appeal but in the mean time, any other ideas/suggestions gratefully received!

First paragraph: you need a sick note dated from the date of Fit For Work decision only.
Two years ago you passed and didn't need to send anything to JCP; now you have been failed you do need them to ensure appeal rate ESA payments once the MR has been done.
This means you will get backdated payment to the date on your sick note, and continue to get payments as long as you keep providing sick notes.
The decision to pass you 2 years ago is not relevant now in terms of sick notes.
It is generally accepted that unless you can do an activity reliably, repeatedly, safely, in a timely manner, you should be treated as unable to do said activity.0 -

No, I'm afraid this is not quite correct.
Since the 2 stage appeal process (1st MR, then Tribunal Service (TS) appeal), ESA payments can only be resumed once your appeal has been lodged with the TS, not whilst you are waiting for the mandatory reconsideration request.
So, it's sensible to get the MR done asap and chase DWP for a response.
KxMx is correct in saying that you will need to supply a fit note to get ESA restarted whilst you wait for the hearing date.

Being off work meant that I was only paid the standard SSP amount although my company have been continuing to pay employee contributions in to my pension fund.

Most mandatory reconsiderations fail. I would advise going to a tribunal with this.
Get help from citizens advice or a charity for your disorder if you can. The CAB should also be able to advise on what to do about your employment situation.0
