No he hasn't. And if he has, they're wrong. Private seller, sold as seen, he had a test drive, you made him aware of issue. You're in the right, he isn't.

    According to the AA website
    https://www.theaa.com/car-buying/legal-rights
"The only legal terms that cover a private sale contract are:
    • The seller must have the right to sell the car.
    • The vehicle should match the description given by the seller.
    • The car must be roadworthy – it is a criminal offence to sell an unroadworthy car and an MOT certificate from a test several months ago is no guarantee that the car is roadworthy today."

To repeat what I posted earlier... see above. He does not have any case against you at all. The law is different for private sellers than for business sellers. For a private seller all you need to know is what the AA states as above. Business sellers need to meet a higher standard in that they are deemed to be experts whereas a private seller cannot be expected to know every fault... as long as you mentioned it and he accepted it then the fact that he test drove it means he accepted it sold as seen. Caveat emptor applies here.. the buyer beware.
Tell him you too have taken advice and that you will not be paying him anything at all and tell him not to contact you again. If he threatens you in any way, tell him you are recording the phone call and that you will contact the police if he continues to harrass you. After that, ignore him.
  • hi there I sold a car privately to a guy that came to devon from Sheffield. he checked the car over was happy paid cash for the car. this morning he was demanding refund or cash to fix the car. he was threatening to bring the car back on a recovery truck or wants £400. he drove the car up to Sheffield no issues. didn't want a receipt. not even sure he had insurance. I have a young family he is a very intimidating looking guy. I saw the car at a cheap price because I need a larger car. I had the car for 2 years never had s problem before he came he said he did a hip ch eck and saw it was a cat d write off . so was aware before he bought it. what should I do please help me

    Simple. Ignore him. Job done.
  • Seems like he had every intention of pulling this trick.

    Cut all contact.

Probably better off starting your own thread rather than bring up a year old one but the advice is still the same assuming you are a private seller the information in post #2 is relevant.
