UKCPS PCN - Leaving Site - (Read FAQs but still unsure)

Hi,

Firstly, apologies if the following can be answered in the FAQs, but I still couldn't work out what I need to do. I'll try to keep it brief and to the point.

05/05/17: Received a windscreen PCN from UKCPS for leaving the parking site.

06/06/17: Received Notice To Keeper as I hadn't made any appeal or contact with UKCPS.

07/06/17: Although I knew I was too late to appeal, I sent the IPC members appeal template from the FAQ page to UKCPS via post.

03/07/17: Received a 'notification letter' in which I have 14 days to reply otherwise they have the right to recover the £100 amount or start court proceedings.

What is the best course of action now? My main defence would be that I left the site under medical grounds (bad stomach) and needed to find appropriate facilities. Is this defence any good? I also have a receipt from the store in the car park (albeit outside the time of maximum stay).

    Leaving site PCNs are very difficult for PPCs to win in court.

    They must show that they did everything possible to mitigate their losses. Ideally the person who saw/photographed you doing so should have warned you of the financial consequences of doing so, did they, or did they hide out of sight?

    Nope. I had no idea they were there. The car park was 90% empty. Apparently they hide in unmarked cars.

    So would you say just wait until I get court papers - if that actually happens?

    Nope don't even try that, you certainly don't admit to it, they have to prove it, and if they do that they would need to explain why they didn't stop you.

    Also you need to keep the drivers details to yourself who ever that might be!

    1 Irrelevant

    2) Of course they do, but that is because they are scammers after their bonus.

    3) Yes, but also expect loads of scrap paper from Muppet faced debt collectors.
