ParkingEye: Small Claims Telephone Mediation Service

Hello Everybody,

I remember parking at the car park and not paying for the parking charges because the machine was broken. There was no power whatsoever. I inquired everywhere at the shops and they mentioned that the machine has been broken for a while.

Nevertheless, After few months I received court claim to pay £150 which I replied that I did not receive any initial notifications at all. How come I was not given a chance to defend myself ? I made all the possible enquiries to pay but there no provisions at all.

So the current progress is that I have accepted to go for mediation.

My argument would that the machine was not working and I do have a witness but I did not take any picture at all as there were so many people who had similar issues. I presumed that it is an issue and so many people are going through it so it is what it is and I shouldnt have any issues.

I need some decent advice ? Please help.

    HOWEVER, do not expect anything from this mediation. it is conducted by someone with no legal knowledge who will not comment on the strength of your case, he'll (or she'll) just see if there is any room for negotiation. The parking company is unlikely to budge either at all or by much. It will be a huge let down.


    When does your defence have to be filed? No harm doing the mediation but please don't assume it will get you anywhere so you need to get on with your defence. Have a go, do some reading/research on this forum and post up a draft for us to help you with.
