Faulty car £13.5k

Options
I bought a car 7 weeks ago from a reputable dealer for £13k in the time that I've had the vehicle it's broken down 4 times for 4 different faults and been repaired by them each time . My car is now with them again after breaking down yesterday and I've Informed them that I am formally rejecting the vehicle and want a full refund .
I have put this in writing via email and a recorded letter but They are avoiding my calls . Where do I stand ? Advice appreciated

The car is within warranty

Regards

Main dealer or car supermarket type place ?

Manufacturers warranty or aftermarket warranty ?

What car and what sort of 'faults' ?

Once information is available folks can help

After one attempted repair, you do have the right to reject the vehicle, but not necessarily for a full refund.

The refund can be reduced to take account of the use you have had.

Correct - but any deduction would be minimal given the OP has only owned the vehicle for 7 weeks and it has probably spent as much time back at the dealer as on the road.

Under such circumstances I'd be pushing for a full refund. Is there anything in the CRA that deals with refunds within the first 6 months (before the burden of liability switches)?

    As would I.

    Yes.

S24 of the CRA states that generally there can be no reduction of a refund to account for use during the first six months, but goes on to say that motor vehicles are an exception to that rule.

Reject a car within 30 days and you are on very clear ground. So long as there is a significant fault then you do not have to give the garage the opportunity to carry out a repair and you are entitled to a full refund.

Reject a car after 30 days but within 6 months and you have to give the garage ONE opportunity to carry out a repair. Technically the garage can deduct money for fair use of the car, but this should be minimal after just seven weeks. Indeed you could flip the coin and argue that you should be compensated given the trouble you've been put through with four breakdowns in that time.

Also worth considering that if you're dealing with a reputable garage that genuinely want to ensure good customer relations, it can actually be advantageous for both parties to work together to get the car repaired. Yes, you might have lost trust in the vehicle but ultimately all cars are repairable. It actually costs the dealer money and hassle to buy a car back. Use this to your advantage to seek reasonable compensation for your trouble. For example, the dealer might agree to £250 / £500 off the price. This will not change your consumer rights.
