PCN Appeal Euro Parking Services Ltd

Hi,


I am currently going through the appeals process with Euro Parking Services Ltd for a ticket that was not displayed (it had fallen off). I still have the original ticket. So far I have followed the procedures recommended for members of the IPC. They have of course rejected my appeal - the latest one citing the Beavis case. I have done lots of research on this forum and have responded citing why the Beavis case is not applicable in this case (the car park charged per hour as opposed to 2 free hours parking) and quoted the court judgement.


My question is, do I send to arbitration when they inevitably come back with another rejection, or is this the time to start ignoring? I am prepared to risk them taking me to court as I feel happy to argue that I did pay and that the charge of £100 far exceeds the pre-estimate of loss (which I stated in my original).

    Pre estimate of loss argument is dead in the water since Beavis, and arguably their second stage of appeal is considered a waste of time as they are just a bunch of scammers supporting the ppc's that pay them.

    Euro Car Parks Limited are an accredited BPA operator, not IPC. In their standard rejection letter, they should have provided you with a 10 digit POPLA Code.

    If this is ECP, they are in the BPA and we win at POPLA almost every time, so not sure what made you think POPLA was pointless?

    If this is ECP, what's the 'date of issue' and what is the 'date' below that (top right on the first postal PCN)?


    Your advice/appeal is out of date and would not win. DO NOT argue this at POPLA stage:

    I didn't appeal as the driver, just the keeper. Sorry, I am a bit confused by all the acronyms! I was under the impression that companies are either a member of BPA or IPC (if at all). The company is Euro Parking Services Ltd not Euro Car Parks - sorry my mistake. I believe it is a member of the IPC.


    I appealed as soon as I got the notice, which I am now presuming I shouldn't have done!!! I read the advice on the moneysavingexpert website, which I now realise again was not the advice given in the forums. The appeal is currently going back and forwards with the IAS. Every time I post my response they just come back with something else. There is an option to refer the case straight to arbitration but I'm not sure if that's the right thing to do?

    Absolutely categorically NOT. You are talking about the 'non-standard' IAS, costing you £15 to throw away all your legal rights and lose, giving you nowhere to go. Covered in the NEWBIES thread post #3, never ever use that £15 IAS rubbish.

    Yes.

    Euro parking services do court currently for less than 10% of tickets issued. They have 6 years to start legal action
