Parking..Court Action

Hi all my problem is with Indigo parking at a rail station. They wrongly issued me with fines and bailiff charges of £3,500 and took no notice of my appeals even though I had a valid season ticket . This caused me to seek legal help and a solicitor got me an apology and all fines and bailiff action cancelled within 4days. I am currently involved in taking indigo to court myself to recover my legal costs but indigo are going to fight the case... can anyone tell me what my chances of success in the courts are likely to be .

    And so you should take Indigo to court.

    They apologised and cancelled everything so how are they going to fight it

    "Companies House says that Indigo Park Services UK Ltd and Indigo Park Solutions UK Ltd are separate companies with different company registration numbers. The GTR witness statement makes clear that IP Services has GTR's authority to manage the car parks, between 18 October 2015 and 17 October 2021, but there is no mention of IP Solutions anywhere in the statement.

    It would therefore appear that IP Solutions has no legal standing to manage any GTR car park covered by this contract. They would have no more legal right to issue penalty charges than I do. That would make all the penalties issued since 18 October 2015 fraudulent. It presumably also means that IP Solutions also has no legal right to clamp vehicles.

    What would happen to Indigo if all the people who have paid fraudulent penalty charges since 2015 were able to claim back their money in the courts? Assume 10,000 people at £100 per head = £1 million quid."

    give that to your solisitor and tell him to check it before instigating charges agaist them

    I have no idea at this time how they intend to fight it , the company is a arrogant and incompetent joke ......They actually used to put the phone down on me when I rang up and started to question them....Unbelievable

    My solicitor is not involved with the case anymore .

    ask them to produce their contact with the TOC , and as you full and well know the land comes under bylaws and they have no right to operate , only the TOC can take you to MAGISTRATES court , and this has to be within 6 mths ,


    you say "fines" and bailiffs , which court was this heard in?

    Not really (not being specific to Indigo but) the industry is made up of scammers and chancers, brainless but greedy ex-clampers. There's no 'customer service' ethic. You can't ring such thugs up meaningfully. Stop phoning.

    What did your claim say? Exactly? And have you done the DQ stage, are you at WS stage?

    They are not taking me to court I won my original case and am now taking them to the small claims court to recover my legal expenses and then am going to try and escalate my case by some other means because I have proved their A N P R system is not working correctly as some days I received a double fine for the same offence but under different reference numbers???. Also their own website failed to register that I had changed my car registration even though I proved that to them.... they still went ahead with fines and setting debt collectors on me . Incompetence on a massive scale and they still refuse to back down .

    My claim against Indigo is quite lengthy to go into here but basically is incompetence on their part caused me to seek legal advice and now I proved I was legally parked I think it's only fair they pay my expenses especially as I pay them over £1,000 a year for a season ticket . I am at the stage where I have applied to begin legal action through the court and am waiting to hear from the courts for a date and on what grounds they are going to defend on .
