Dear Experts,

Though not new to the Forum but an infrequent user. Have been helped by the forum in the past for getting my parking penalty cancelled (for which one is ever so thankful).

Landed into a similar situation and need help please. The driver parked at Cockhedge Shopping Park on XX/06/17 and stayed for a total of 2hrs 25 mins. Received a PCN dated XX/06/17.

The driver wouldn't call it a deliberate mistake but the driver knew that they had overstayed. The driver went to the paying point but was confused at what to do.Thinking that they should have paid for the time in advance and not at the time of exit the driver looked for the parking warden for help but there was none around. And as the driver was getting late left in a confused state. Just wanted to check with the experts that should the driver accept this as their mistake and pay upfront in time and avail the discount or do they have any ground to fight.

The PCN shows the IN and Out pictures of the car and clear number plate and the timings.At the bottom shows the payment information. The back of the letter is split into - Parking Charge Fine, Protection of Freedoms Act, Appeal and Complaints Procedure and Further Information.

Have not appealed yet. Looking forward to your help and suggestions. Thanks

    Use the initial appeal template (the one in blue text) from the NEWBIES FAQ sticky, post #1. It will rejected with a POPLA code being provided for you to appeal there.

    Once you've sent off the initial appeal (via the method outlined by PE) get on with reading post #3 of the sticky to gain an understanding of how to appeal to POPLA and how to use the ready-written POPLA appeal templates.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Before starting a thread you are (politely) asked to read the newbies faq thread near the top of the forum which tells you exactly what to do and when


    You need to edit your post to remove details of who was driving!

    its worth noting that very few car parks monitored by ANPR cameras will actually have a "parking warden" on site , so although it was a reasonable idea, in practice these modern systems are not like "the good old days" where people were on site and you dealt with them on a personal basis

    in future, assume that there are NO parking wardens at all, unless you find out differently, and plan accordingly

    the more that they use cameras and computers, the less staff are employed, making greater costs savings

    and lesson for the future, NEVER reveal who did what on a public forum accessed by millions of people , including whoever you might be referring to (like PE)

    PPC,s monitor public forums and can screenshot any admissions of "guilt" or where the "story of what happened" has been revealed

    in essence , the words "ME , MYSELF and I" are banned , so a bit like pleading the "fifth" in the USA (the fifth amendment to their constitution)
