Yes, using the words I gave you which were based on your own, but tweaked. It is vital that your defence actually states that payment WAS made for the stay. Just don't imply which of you was the driver.

Thank you coupon-mad, I will indeed assume I didn't mention it. I did ask earlier in the thread if I was doomed if I did mention who the driver was and I thought the answer was no. I do hope that if I did mention it in my appeal, it won't hinder my chances of defending myself in court, should it get there. I plan to document everything that happens at every stage of these proceedings so as to help anyone else in the same position as me.
I will repost a tweaked version shortly, taking into account the comments received on the first draft.

You aren't doomed if you admitted to being the driver. It just rules out POFA defences
But if you did admit it in writing and change your story now in writing you can expect them to draw it to the judges attention and point out you are prepared to lie0 -

I would leave it in and not worry about it. You will see their evidence at WS stage if they proceed that far and then you will know (and can adjust your stance & main defence point, at the hearing, if needed). Yes it's obvious they are getting hundreds or thousands of people at each stage to pay out of fear. My initial thought was to pay when the court papers came. I'm sure people pay at the debt collection stage, the letter before court, the court letter... So they've probably factored in a few defences and a few payers, and overall it's probably working out well for them... Thanks for getting back to me.

WS = Witness Statement, some weeks before the hearing, if the case progresses. I honestly believe they are seeing lots of victims blink, whereas we know they shy away from hearings when well defended.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
