Agency haven't given me any work, will I be taxed if I started new job?

I was working a Christmas temp job towards the end of last year which I quite enjoyed, and the only way of staying on was through an agency that they use. Even though agency staff I met didn't have a nice word to say about the agency. When the casual employment was over, my P45 was given to me as well as the usualHMRC documents.
I applied in January but didn't hear anything and found myself a more permanent job elsewhere in which I started in February, although this wasn't working out for me and the agency responded to me in March, and I signed the paperwork at the end of March.
The most important document signed was the HM Revenue & Customs tax form, where I had to state that the agency would be my second job since the tax year (as I was still employed at the time by the permanent position. However I left this role around a week after signing my documents to the new job, again my P45 documents were sent out to me showing me how much I'd earned for the year. So in reality, to the tax man, the agency job would be my only job at the moment?
Since then I have just been messed around by the agency, they've been promising me inductions since April and I haven't had one, never mind any shifts! It's nearly July and I've tried ringing them up to terminate my employment but they're proving harder to deal with than pulling teeth!
I've been looking for new employment for around a month now but at this moment I'm not having much luck. But here is my dilemma:
Due to me signing to HMRC that I would be working for the agency, if I find a new job, will they tax me on the fact that this would be a 'second job?' despite not even having a starting date for this current one?

What is the date on the P45 from your former permanent job? Is it this tax year or last?
If I were you, when I got a new permanent job I would write to the agency which isn't actually giving you any work and tell them you will not be doing any more work for them and ask for a P45.0 -
i suppose you could be emergency taxed for the first month but then you can call hmrc and explain that you have left the agency. provided you do actually leave the agency. but even so, you can allocate your 1150 code to your job.CCCC #33: £42/£240
DFW: £4355/£44050 -

I'll have to dig my permanent job P45 out later but I think it is taxed to 2016/17.
In regards to requesting my P45 to the agency, that's the other thing I've tried to do. I phoned them up and got told an email address that I didn't catch but she hung up on me before I could ask to repeat. And then I emailed another guy who said he'd forward it onto the relevant department. This was about four weeks ago, I still haven't heard anything.
Absolute waste of time! I bumped into a lady in the supermarket today who I used to work with and she was part of the agency, and has been for many years, she said they've been letting a lot of people down just recently, and showed me a text message she'd got this morning telling her and other staff if they haven't had any texts regarding shifts, don't bother ringing up asking for any either..:mad:0 -
If you no longer consider this agency to be your main job and find a new employer the best thing to do would be to ask the new employer for a new starter declaration form and complete this to show this new job is your main employment but that you have had another job in the same tax year. It used to be called "statement B" on the old tax form P46.
This will mean your new employer immediately allocates you with the emergency tax code but this is actually the bog standard tax code it just doesn't get backdated to the start of the tax year. If you paid weekly you will be able to earn £221 per week before they deduct any tax.
You should continue to try and resolve things with the agency but lack of a P45 from them won't cause that many issues in the short term.0 -
Start your new job and sign the "this is my only/main job" form.
If/when the agency phone you with work offers, just say no.0 -

Right, I'll do just that, I have an interview tomorrow for a new place so I've got my fingers crossed that I'll finally be back in work!0
