Deed of Renunciation

Hi guys

Trying to help my father in law for his mothers estate. His two brothers and sister are executors. However, his brother and sister are abroad and cannot deal with the estate. We have drafted a deed of renunciation and will be sending it off to the probate registry office. Is there a fee payable and do we need to apply for grant of probate at the same time or can that follow later?

    You don't need deeds of renunciation. If you site this as a reason in section 3.7 in form PA1 the probate office will send you another form that his 2 siblings will need to sign.

    I would suggest that they actually opt for powers reserved instead. Your FIL will still be able to do everything himself but should anything happen to him during the process one of the others can step in.It would also avoid any additional forms to be completed.

    You don't need to. It will just complicate matters. Doing as KP says will be quicker.
