They can't stop the charge because SAS are no longer their contractors. They have no influence at all and SAS would tell them to do one!

Don't worry about this, the charge IS defendable - but not without our help. If SAS try a small claim come here BEFORE writing any defence!

Related to the above - who is responsible for the wording of the contractual sign which I believe is unfair as it requires the driver to be responsible for what happens in their car when they are not in it i.e. the permit falling on the floor? S-A-S have said it's the landowner and they merely enforce it. So if I have an issue with the contractual sign it should be a complaint to the landowner rather than the parking company. Is that correct?

It's unlikely the landowner developed the sign. Most PPC signs are generic, apart from 'personalising' it to the location. Sometimes a landowner can be quite hands-on with the content of the sign, but by and large it's mostly the PPC's work. However, I think SAS are probably throwing you a general fob-off line to get you off their back.

But whatever is on the sign, or whoever is responsible for it, the landowner is jointly and severally liable for the actions of their agent.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks - good point. I'll keep that in my back pocket for the landowner.
