Smart Parking claims, using SCS law, have appeared a few times recently (they've never tried before and are not the sharpest knives in the drawer).
Guess how many have ended in a hearing? NONE. All were discontinued with a defence we assisted with, all for newbies, scared out of their wits. Trust us! Tell your wife to please trust me, I'm just a wife and Mum as well.
Anyone who pays is a numpty (sorry, 'tis true - it is NOT something to pay). There is NO POINT paying this thing, no risk, as long as you stick around here. Even if a case went to a small claim she could settle the day before a hearing (no CCJ, nothing) if our advice failed. It doesn't fail.
But let's try POPLA first, even though a few toes have been shot off by admitting who was driving. Can we pretend she didn't choose 'driver' in her appeal? Did she definitely? Or did she write letters?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I will check to see how she worded it. She did it online so it will be all through memory. Has anyone had the same.situation as us? Paying for 12 hours and thinking they can return? Did you look at sign I posted? What do you think of the wording?0

I agree, the sign is unclear (deliberately).
And re your wife stating she was driving, tell her never to do that again with a private parking 'firm' - but that it happens all the time on here. She is far from alone. And we still win every case v Smart, whether at appeal or defence stage (no court hearing, honestly, if our advice didn't stop the case, which it likely would, then she could settle it at any time).
Give us a chance to do our magic and get these stopped, even in a defence. But first, let's try POPLA. Put together the template POPLA appeal points from post #3 of the NEWBIES thread and show us the draft.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
